Section 84: Admission or Rejection of Fresh Start Application under the IBC
Section 84 of the Insolvency and Bankruptcy Code, 2016 (IBC) describes how the Adjudicating Authority considers a fresh start application after receiving the resolution professional's report, what an admission order must specify, and when creditors must be informed.
Meaning and scope of Section 84
The provision belongs to Chapter II (Fresh Start Process) of Part III, concerning individuals and partnership firms. Its function is to provide a decision stage after examination of a debtor's application by a resolution professional under Section 83.
Section 84(1): Admission or rejection within fourteen days
The Adjudicating Authority may, within fourteen days from submission of the resolution professional's report, pass an order admitting or rejecting the fresh start application referred to in Section 81(1). The fourteen-day period is measured from submission of the report, not from the debtor's original filing.
The resolution professional's report under Section 83 recommends acceptance or rejection and records reasons. The Adjudicating Authority makes the decision under Section 84; the recommendation is not itself an admission order.
Section 84(2): Contents of an admission order
If the application is accepted, the order must state the amount accepted by the resolution professional as qualifying debts and the other amounts eligible for discharge under Section 92 for purposes of the fresh start order.
Qualifying debt is a defined expression under Section 79, read with the eligibility conditions of Section 80. It does not mean every liability disclosed by the debtor. Section 92 addresses the eventual discharge of qualifying debts and certain other liabilities under the statutory fresh start framework.
Section 84(3): Notice to creditors within two days
A copy of the Adjudicating Authority's order, together with a copy of the application, must be provided to the creditors named in the application within two days after the order is passed.
Important update: Older reproductions of Section 84(3) state seven days. The updated official IBBI compilation states two days. The current text should be consulted rather than relying on older versions.
Key statutory timelines
| Stage | Provision | Time period |
|---|---|---|
| Resolution professional examines application and reports | Section 83(1) | Within 10 days of appointment |

What follows admission?
Under Section 85, admission triggers the moratorium contemplated for the fresh start process and associated restrictions on the debtor. Sections 86 and 87 address creditor objections and challenges to the resolution professional's decisions. Section 91 addresses revocation of an admission order, while Section 92 governs discharge. These provisions must be read together; an admission order is not identical to a discharge order.
