Order XLI Rule 8 CPC - Powers in Appeals Against Execution Orders

Order XLI Rule 8 of the Code of Civil Procedure, 1908 (CPC) extends the powers relating to stay of execution and security under Rules 5 and 6 to appeals concerning orders made in execution of a decree. The provision is relevant when an appeal lies against an execution order rather than the original decree.

Order XLI Rule 8 CPC - Statutory provision

The powers conferred by rules 5 and 6 shall be exercisable where an appeal may be or has been preferred not from the decree but from an order made in execution of such decree.

This is the central rule. It does not itself create a new right of appeal against every execution order; appealability must be established under the CPC or another applicable law.

Meaning and scope of Order 41 Rule 8

Order XLI governs appeals from original decrees and related appellate procedure. Rule 8 makes the protective powers under Rules 5 and 6 available, where applicable, in an appeal from an order passed during execution proceedings.

An execution order is an order made in proceedings to enforce a decree. A decree is defined in Section 2(2) CPC, while an order is defined in Section 2(14) CPC. The distinction matters because an appeal from an order ordinarily requires express statutory authorization.

How the provision operates in practice

  1. Identify the execution order: Obtain the impugned order and determine whether an appeal is legally maintainable.
  2. File the appropriate appeal: Comply with the prescribed forum, limitation period, court fee and procedural rules.
  3. Seek interim protection: Where necessary, apply for a stay under Order XLI Rule 5 as extended by Rule 8, explaining the grounds and supporting them with evidence.
  4. Address security: Where relevant, request or offer suitable security under Rule 6 and comply with directions of the court.
  5. Obtain a specific order: Execution does not stop automatically merely because the appeal or stay application has been filed.

Example: If an execution order is independently appealable and the appeal raises a serious issue concerning a proposed property sale, the appellant may seek appropriate protective relief under Rules 5 and 6 read with Rule 8. The court will assess the statutory requirements and case-specific facts.
