Order XXI Rule 21 CPC - Simultaneous Execution Against Person and Property

Order XXI Rule 21 of the Code of Civil Procedure, 1908 (CPC) gives an executing court discretion to refuse execution of a decree at the same time against both the person and the property of a judgment-debtor.

Text of Order XXI Rule 21 CPC

Rule 21 - Simultaneous execution

"The Court may, in its discretion, refuse execution at the same time against the person and property of the judgment-debtor."

Meaning and scope of Rule 21

The rule concerns the simultaneous use of two execution methods: proceeding against a judgment-debtor personally, such as through arrest and detention where legally permitted, and proceeding against the judgment-debtor's property, such as by attachment and sale. The word "may" makes refusal discretionary rather than automatic. The court must consider the facts, the nature of the decree and applicable safeguards.

Rule 21 does not itself authorize arrest, attachment or sale. Those powers and their conditions arise under other provisions of the CPC. It also does not impose a general prohibition on using more than one execution method.

How the court exercises discretion

Illustration: A decree-holder seeks attachment of the judgment-debtor's property and also asks for arrest in execution of a money decree. The court may refuse to proceed against both person and property simultaneously under Rule 21. Any order for arrest or detention must additionally meet the separate conditions imposed by Section 51 and Order XXI.
