Section 123 CrPC: Power to Release Persons Imprisoned for Failing to Give Security

Section 123 of the Code of Criminal Procedure, 1973 provides for discharge, relaxation of security requirements, conditional release and cancellation of bonds. Its corresponding provision under the Bharatiya Nagarik Suraksha Sanhita, 2023 is Section 142 BNSS.

Current law: The BNSS came into force on 1 July 2024 and generally replaced the CrPC for new criminal procedure matters. Section 142 BNSS corresponds to Section 123 CrPC. For proceedings already pending at commencement, check the saving and transitional provisions in Section 531 BNSS and the applicable judicial orders.

Meaning and scope of Section 123 CrPC

The provision addresses persons imprisoned because they failed to furnish a bond or sureties required for keeping the peace or maintaining good behaviour. It gives designated judicial or executive authorities discretion to release a person when release is considered safe, and allows specified authorities to reduce the amount, number of sureties or period of security.

Security is an undertaking, commonly backed by a bond and where ordered by sureties, to keep the peace or maintain good behaviour. A surety is a person who undertakes responsibility under the terms of the bond. Conditional discharge means release subject to accepted conditions that remain operative only within the original security period.

The following preserves the ten substantive subsections of Section 123 of the Code of Criminal Procedure, 1973. Editorial amendment-number markers in the earlier website text have been removed for readability.

(1)

Whenever 1[the District Magistrate in the case of an order passed by an Executive Magistrate under section 117, or the Chief Judicial Magistrate in any other case] is of opinion that any person imprisoned for failing to give security under this Chapter may be released without hazard to the community or to any other person, he may order such person to be discharged. (2) Whenever any person has been imprisoned for failing to give security under this Chapter, the High Court or Court of Session, or, where the order was made by any other Court, 2 [District Magistrate, in the case of an order passed by an Executive Magistrate under section 117, or the Chief Judicial Magistrate in any other case], may make an order reducing the amount of the security or the number of sureties or the time for which security has been required. (3) An order under sub-section (1) may direct the discharge of such person either without conditions or upon any conditions which such person accepts: Provided that any condition imposed shall cease to be operative when the period for which such person was ordered to give security has expired. (4) The State Government may prescribe the conditions upon which a conditional discharge may be made. (5) If any condition upon which any person has been discharged is, in the opinion of 2 [District Magistrate, in the case of an order passed by an Executive Magistrate under section 117, or the Chief Judicial Magistrate in any other case] by whom the order of discharge was made or of his successor, not fulfilled, he may cancel the same. (6) When a conditional order of discharge has been cancelled under sub-section (5), such person may be arrested by any police officer without warrant, and shall thereupon be produced before the 2 [District Magistrate, in the case of an order passed by an Executive Magistrate under section 117, or the Chief Judicial Magistrate in any other case]. (7) Unless such person gives security in accordance with the terms of the original order for the unexpired portion of the term for which he was in the first instance committed or ordered to be detained (such portion being deemed to be a period equal to the period between the date of the breach of the conditions of discharge and the date on which, except for such conditional discharge, he would have been entitled to release), 2 [District Magistrate, in the case of an order passed by an Executive Magistrate under section 117, or the Chief Judicial Magistrate in any other case] may remand such person to prison to undergo such unexpired portion. (8) A person remanded to prison under sub-section (7) shall, subject to the provisions of section 122, be released at any time on giving security in accordance with the terms of the original order for the unexpired portion aforesaid to the Court or Magistrate by whom such order was made, or to its or his successor. (9) The High Court or Court of Session may at any time, for sufficient reasons to be recorded in writing, cancel any bond for keeping the peace or for good behaviour executed under this Chapter by any order made by it, and 3 [District Magistrate, in the case of an order passed by an Executive Magistrate under section 117, or the Chief Judicial Magistrate in any other case] may make such cancellation where such bond was executed under his order or under the order of any other Court in his district. (10) Any surety for the peaceable conduct or good behaviour of another person ordered to execute a bond under this Chapter may at any time apply to the Court making such order to cancel the bond and on such application being made, the Court shall issue a summons or warrant, as it thinks fit, requiring the person for whom such surety is bond appear or to be brought before it. ---------------------- 1. Section 142 BNSS, 2023 - Current corresponding provision

Section 142 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is titled "Power to release persons imprisoned for failing to give security". It retains the principal framework of former Section 123 CrPC, with updated statutory cross-references, including Section 136 BNSS (corresponding to Section 117 CrPC) and Section 141 BNSS (corresponding to Section 122 CrPC).

  • Section 142(1): The District Magistrate for an Executive Magistrate's order under Section 136, or the Chief Judicial Magistrate in other cases, may order discharge if release poses no hazard to the community or another person.
  • Section 142(2): The competent authority may reduce the amount of security, number of sureties or required duration.
  • Sections 142(3)-(4): Discharge may be unconditional or subject to accepted conditions; State Government rules may prescribe conditions. Conditions end when the security period expires.
  • Sections 142(5)-(8): Breach of conditional release may result in cancellation, arrest without warrant, production before the competent authority and remand for the unexpired period, subject to the opportunity to furnish the required security.
  • Sections 142(9)-(10): Certain courts and magistrates may cancel bonds; a surety may apply for cancellation of the bond, triggering the required appearance process.

For the authoritative wording, consult the official BNSS, 2023 text on India Code (PDF), particularly Section 142.

How release or reduction of security may be sought

  1. Identify the underlying order: Obtain the original security order, imprisonment or detention order, and bond particulars.
  2. Approach the competent authority: Determine whether the original order was made by an Executive Magistrate or another court; the competent authority differs accordingly.
  3. Explain the grounds: Present circumstances supporting safe release or reduction in security, sureties or duration.
  4. Request suitable relief: Seek unconditional discharge, conditional discharge, reduction of security or cancellation of the bond, as appropriate.
  5. Comply with conditions: Breach of a conditional discharge may lead to cancellation and further detention for the legally applicable unexpired period.

These are general procedural considerations, not a substitute for examining the court record, applicable rules or case-specific remedies.
