Section 441 CrPC - Bond of Accused and Sureties | Section 485 BNSS
A guide to bail bonds, the obligations of an accused person and sureties, court attendance, and verification of sureties under Indian criminal procedure law.
Meaning of a bond and a surety
A bond is a formal undertaking by an accused person to comply with specified requirements, including attendance before the police officer or court. A bail bond involves an undertaking supported by one or more sureties. A surety is a person who undertakes responsibility under the bond for the accused person's compliance with its terms. The amount and conditions are determined in accordance with the applicable law and judicial order.
Section 441 CrPC - Bond of accused and sureties
Sub-section (1): Before release on bail or on a personal bond, the accused must execute a bond for an amount considered sufficient by the police officer or court. Where bail requires sureties, one or more sufficient sureties must also execute the bond. The accused must attend at the stated time and place and continue attending until otherwise directed.
Sub-section (2): Any condition imposed for release on bail must be included in the bond.
Sub-section (3): Where required, the bond must also secure the accused person's appearance before the High Court, Court of Session or another court when called upon to answer the charge.
Sub-section (4): To determine whether sureties are fit or sufficient, the court may accept supporting affidavits, conduct an inquiry itself or direct a subordinate Magistrate to make an inquiry.
Section 485 BNSS - Current corresponding provision
Section 485 of the BNSS carries forward the principal requirements of Section 441 CrPC. It uses the terminology bond or bail bond and provides for execution of the required undertaking, inclusion of bail conditions, appearance before the relevant court and judicial assessment of the fitness or sufficiency of sureties.
The section does not itself prescribe a fixed bond amount for every case. Under Section 484 BNSS, the amount of a bond must be fixed with due regard to the circumstances of the case and must not be excessive. The High Court or Court of Session may direct reduction of bail required by a police officer or Magistrate.
Practical requirements for bail bonds
- Execution: The accused must execute the bond, and sureties must execute the bail bond where required by the release order.
- Attendance: The bond identifies the required time and place of attendance and continues to bind the person until a competent direction changes that obligation.
- Conditions: Conditions of bail imposed by the competent authority should be reflected in the bond or bail bond.
- Surety scrutiny: The court can assess a proposed surety's identity, fitness and sufficiency through affidavits or inquiry.
- Declaration: Section 441A CrPC, corresponding to Section 486 BNSS, requires a surety to declare the persons for whom the surety has stood, including the accused.
Andhra Pradesh state amendment to Section 441 CrPC
The Code of Criminal Procedure (Andhra Pradesh Amendment) Act, 2018, published as Andhra Pradesh Act 17 of 2019, provided for the addition of the following words to Section 441(1) of the CrPC:
"and for imposition of a fine not exceeding the amount prescribed in the surety bond, in case the surety fails to produce the accused on the date fixed by the court in grave/serious offences."
The Act specifies commencement on a date appointed by state notification. Its commencement and continuing effect after the BNSS transition should be checked against the relevant notifications and applicable law before relying on it in a current case. See the Andhra Pradesh official gazette publication.
Related provisions on bail and sureties
Section 486 BNSS concerns declarations by sureties; Section 487 addresses discharge from custody; Section 488 addresses insufficient bail; and Section 489 concerns discharge of sureties. Provisions governing forfeiture and cancellation of bonds are found in Sections 491 and 492 BNSS respectively.
