Section 77 CrPC: Where an Arrest Warrant May Be Executed - Section 79 BNSS

An arrest warrant issued by a competent court is not confined to the district or State in which it was issued. Section 77 of the Code of Criminal Procedure, 1973, and its successor, Section 79 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), establish its territorial reach throughout India.

Text of Section 77 of the Code of Criminal Procedure, 1973

The provision addresses the territorial validity of a warrant of arrest. It does not remove the need to comply with other statutory rules governing the execution of warrants, notification to the arrested person, transit procedures and production before a court.

Current Law: Section 79 of the BNSS, 2023

The Bharatiya Nagarik Suraksha Sanhita, 2023 (Act 46 of 2023), came into force on 1 July 2024, replacing the CrPC subject to its repeal and savings provisions. Section 79 BNSS is the corresponding provision and retains the same operative wording.

For proceedings covered by the BNSS, Section 79 is the relevant provision. The former CrPC provision remains important when interpreting earlier proceedings and cases preserved by the savings clause in Section 531 BNSS.

Meaning and Scope of the Provision

1. Nationwide territorial reach

A court-issued arrest warrant can be executed anywhere within India, including outside the State or district of the issuing court. The State border does not, by itself, invalidate the warrant.

2. The executing officer must follow the prescribed procedure

Section 79 BNSS does not independently authorise every person to execute every warrant. Sections 74 to 76 BNSS address to whom warrants may be directed and how they may be executed by authorised persons. Sections 80 and 81 BNSS prescribe procedures relevant to execution outside the issuing court's local jurisdiction.

3. Safeguards for the arrested person continue to apply

Under Section 77 BNSS, the person executing the warrant must notify the person to be arrested of its substance and show the warrant if required. Section 78 BNSS requires production before the appropriate court without unnecessary delay, subject to its statutory 24-hour limit excluding necessary journey time. Article 22 of the Constitution also provides safeguards concerning arrest and detention.

4. Arrest outside the issuing district

Where a warrant is executed outside the issuing district, Section 82 BNSS contains special rules on the authority before whom the arrested person must ordinarily be taken, together with specified exceptions. The procedure is not simply an unrestricted right to transport the person directly to the issuing court.

Practical Example

Suppose a court in Delhi issues an arrest warrant against a person who is later located in Mumbai. The warrant may be executed in Mumbai under Section 79 BNSS. However, the executing officer must also comply with the applicable rules on endorsement, local assistance, communication of the warrant and production before the appropriate authority.

Important: The nationwide validity of a warrant does not establish that the warrant was lawfully issued or that its execution was procedurally correct. Those are separate legal questions.
