Section 9: Appointment of Principals of Police Training Institutions

Full text of Section 9 - Delhi Police Act, 1978

(1) (a) The Administrator shall appoint a police officer not below the rank of a Deputy Commissioner of Police to be the Principal of the Police Training School for Delhi.

(b) The Commissioner of Police may by general or special order assign to the Principal of the Police Training School such powers and duties as he may deem fit for the proper functioning of that School.

(2) (a) The Administrator may establish a Police Training College for Delhi and appoint a police officer of appropriate rank to be the Principal of such College.

(b) The Commissioner of Police may by general or special order assign to the Principal of the Police Training College such powers and duties as he may deem fit for the proper administration of that College.

Meaning and legal effect of Section 9

Section 9(1)(a): Appointment of the Police Training School Principal

The Administrator must appoint a police officer as Principal of the Police Training School for Delhi. The appointee must hold at least the rank of Deputy Commissioner of Police; an officer below that rank does not meet the express statutory qualification.

Section 9(1)(b): Powers and duties of the School Principal

The Commissioner of Police may assign powers and duties to the Principal by a general or special order to ensure the proper functioning of the School. The precise responsibilities depend on the applicable order, rather than arising in identical form for every Principal directly from this clause.

Section 9(2)(a): Police Training College

The Administrator may establish a Police Training College for Delhi and appoint a police officer of appropriate rank as Principal. Unlike the Police Training School provision, this clause does not itself prescribe a minimum rank of Deputy Commissioner of Police for the College Principal.

Section 9(2)(b): Administration of the College

The Commissioner of Police may assign the College Principal powers and duties through a general or special order for proper administration of the College. Any specific authority should therefore be considered in light of the governing orders and other applicable legal provisions.

Police Training School and Police Training College: Key distinctions

Police Training School: The Administrator shall appoint a Principal who is a police officer not below Deputy Commissioner of Police rank.
Police Training College: The Administrator may establish the College and appoint a Principal of appropriate police rank.
Delegated functions: In either case, the Commissioner of Police may specify powers and duties by general or special order.
