Indian Insolvency Law / IBC 2016

Section 3 Definitions - Insolvency and Bankruptcy Code, 2016

Updated: 21 October 2026 | Part I - Preliminary

Section 3 sets out general legal definitions used throughout the Insolvency and Bankruptcy Code, 2016 (IBC), including claim, creditor, debt, default, corporate debtor, financial service provider and security interest.

2026 legislative update: The Insolvency and Bankruptcy Code (Amendment) Act, 2026 introduced definitions concerning registered valuers and service providers and an explanation concerning security interest. Check the official IBBI Acts register and commencement notifications for authoritative enacted wording and operative dates.

Scope and application of Section 3

The opening expression "unless the context otherwise requires" means these definitions generally apply across the Code, subject to a contrary context or a specific provision. Section 5 contains additional definitions relevant to corporate insolvency resolution. A claim under Section 3(6) is broader than a debt under Section 3(11), while a default under Section 3(12) involves failure to pay an amount that has become due and payable.

Read the official India Code Section 3 entry and the IBC Act record for the legislation.
