Section 88 of the Insolvency and Bankruptcy Code, 2016: General Duties of Debtor
Section 88 sets out the debtor's continuing duty to cooperate with the resolution professional and promptly disclose important corrections or changes during a fresh start process.
What Section 88 provides
Section 88, headed "General duties of debtor", imposes the following obligations on the debtor:
Section 88(a): Cooperation with the resolution professional
The debtor must make available to the resolution professional all information relating to the debtor's affairs, attend meetings, and comply with the resolution professional's requests in connection with the fresh start process.
Section 88(b)(i): Correction of material errors or omissions
The debtor must inform the resolution professional as soon as reasonably possible of any material error or omission in information or documents already supplied.
Section 88(b)(ii): Disclosure of changes in financial circumstances
The debtor must also promptly inform the resolution professional of any change in financial circumstances after the application date that affects the fresh start process.
Meaning of key terms
Debtor: The individual seeking relief through the fresh start procedure under the relevant provisions of Part III of the Code.
Resolution professional: The insolvency professional appointed in accordance with Section 82 to examine the application and perform the functions assigned under the fresh start chapter.
Material error or omission: An inaccuracy or missing fact significant enough to affect the assessment of eligibility, debts, assets, liabilities, or the conduct of the process. Section 88 does not provide a separate numerical threshold for materiality.
Change in financial circumstances: A post-application development that affects the process, such as a substantial change in income, assets, or liabilities. The duty concerns changes that have an impact on the fresh start process.
How the duties operate in practice
- Provide complete records: Make relevant financial information and supporting documents available when requested by the resolution professional.
- Attend and cooperate: Respond to reasonable requests and attend meetings relating to the fresh start process.
- Correct mistakes promptly: Notify the resolution professional when a material inaccuracy or omission is discovered, rather than waiting for a later review.
- Report important developments: Disclose changes arising after the application that could affect eligibility, the debt assessment, or other aspects of the process.
- Keep a record: Retain copies of disclosures and correspondence so that the timing and content of cooperation can be demonstrated.

Frequently asked questions
Does Section 88 require the debtor to disclose all financial information?
The debtor must make available all information relating to the debtor's affairs to the resolution professional and comply with requests connected with the fresh start process. The provision also requires notification of material errors and relevant post-application changes.
When must an error or financial change be reported?
Section 88(b) uses the standard "as soon as reasonably possible". It does not specify a fixed number of days for these notifications.

No. Section 88 deals principally with cooperation and disclosure. Section 85 separately addresses the legal effect of admission, including the moratorium and restrictions on the debtor.
Does the fresh start process automatically apply to all individual debtors?
No. Its availability depends on the relevant commencement notifications and statutory eligibility. Readers should verify the operative framework before filing or advising on an application.
