Section 10B of the Income-tax Act, 1961: 100% Export-Oriented Undertakings
Section 10B of the Income-tax Act, 1961 historically provided a deduction for export profits of qualifying 100% export-oriented undertakings (EOUs). It is important to distinguish this historical relief from the tax position applicable today.
What was the Section 10B deduction?
Section 10B(1) provided, subject to its conditions, a deduction of qualifying export profits derived by an approved 100% EOU manufacturing or producing articles, things or computer software. The general deduction period was ten consecutive assessment years beginning with the year relevant to commencement of production. Transitional provisions addressed undertakings already claiming relief under earlier versions of the section. For assessment year 2003-04, the statutory deduction rate was 90%.
Expiry: The statutory sunset is assessment year 2012-13, not a fresh ten-year deduction available to newly established EOUs today. Mere EOU approval does not establish entitlement to section 10B relief for later assessment years.
Eligibility requirements under Section 10B(2)
- The undertaking manufactured or produced articles, things or computer software.
- It was not formed by splitting up or reconstructing an existing business, except the specified revival circumstances linked to section 33B.
- It was not formed by transferring previously used machinery or plant to a new business, subject to the applicable statutory explanations.
- It met the statutory definition of an approved 100% export-oriented undertaking.
Export-profit deduction under Section 10B(4)
The eligible export profit was calculated using the proportionate formula:
For illustration only, if eligible business profit was Rs. 20 lakh, export turnover Rs. 80 lakh and total turnover Rs. 100 lakh, the formula yields Rs. 16 lakh of attributable export profit before applying the statutory conditions and limits for the relevant historical assessment year.
Foreign exchange and reporting conditions
Section 10B(3): Receipt of export proceeds
Export proceeds were required to be received in or brought into India in convertible foreign exchange within six months from the end of the previous year or within a further period permitted by the competent authority. The Reserve Bank of India, or another legally authorized foreign-exchange regulator, was the competent authority. The provision also recognized specified RBI-approved overseas bank accounts.
Section 10B(5): Accountant's report
A prescribed accountant's report certifying the claim was required for the relevant years. Historical compliance requirements include Form 56G and the applicable return-filing rules. The statutory proviso also required the income-tax return to be furnished by the due date under section 139(1) for claims to which it applied.
Important statutory definitions

- An undertaking approved as a hundred per cent export-oriented undertaking by the designated Board under the framework referred to in Explanation 2 to section 10B.

Other material provisions
Section 10B(6): Depreciation, losses and overlapping relief
The provision included special historical rules concerning depreciation, specified loss carry-forwards and avoidance of overlapping deductions under sections 80HH, 80HHA, 80-I, 80-IA and 80-IB. The applicable year and wording must be checked carefully.
Section 10B(7): Related-party and transfer adjustments
Specified provisions of section 80-IA(8) and (10) applied, so that transactions with connected businesses and arrangements producing more than ordinary profits could be examined under the statutory rules.
Section 10B(7A): Amalgamation and demerger
For qualifying transfers between Indian companies under a scheme of amalgamation or demerger, the provision addressed the deduction year of transfer and treatment of the successor company, subject to the unexpired eligible period.
Section 10B(8): Opting out
An assessee could furnish the prescribed written declaration before the section 139(1) due date to opt out of section 10B for the relevant assessment years.
Position under the Income-tax Act, 2025
The Income-tax Act, 2025 came into effect on 1 April 2026. Section 10B of the 1961 Act is a historical deduction provision and does not authorize fresh deductions for tax years beginning under the new law. Historical claims and proceedings must be evaluated under the law governing the relevant year and applicable repeal-and-savings rules. Section 10AA concerns a distinct Special Economic Zone regime and should not be confused with section 10B.
