Section 139AA of the Income-tax Act, 1961: Quoting Aadhaar Number and Linking PAN
Section 139AA governs quoting an Aadhaar number in specified income-tax contexts and linking Aadhaar with a Permanent Account Number (PAN). This guide explains the statutory requirements, exemptions and practical consequences of non-linking.
Reviewed: 26 October 2026 | Applicability depends on the relevant tax year and current notifications.
What is Section 139AA?
Section 139AA, inserted by the Finance Act, 2017, concerns the use of Aadhaar in income-tax administration. PAN is a ten-character alphanumeric tax identifier. Aadhaar number is the identification number issued under the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016. These are distinct identifiers; the linking requirement applies to persons covered by the law and relevant notifications.
Legal provisions of Section 139AA
Sub-section (1): Quoting Aadhaar
Under the provision as originally enacted, a person eligible to obtain Aadhaar was required, from 1 July 2017, to quote the Aadhaar number in a PAN application and in the income-tax return. The original provision also permitted an Aadhaar enrolment ID where an Aadhaar number had not yet been allotted. That historical enrolment-ID wording should not be treated as a continuing alternative without checking later amendments and the rules applicable to the filing date.
Sub-section (2): Intimation of Aadhaar for existing PAN holders
Persons allotted PAN as on 1 July 2017 who were eligible for Aadhaar were required to intimate their Aadhaar number in the prescribed manner by the notified date. The statutory consequence of non-compliance must be read with later amendments, rules and notifications, including the framework for an inoperative PAN.
Sub-section (3): Notified exemptions
The Central Government may notify persons, classes of persons or geographic areas to which the requirements do not apply. Eligibility for an exemption should be checked against the applicable notification and the person's actual status.
Explanation: Defined expressions
The provision refers to definitions of Aadhaar number, enrolment and resident under the Aadhaar Act, 2016. The original statutory explanation also defined an Aadhaar enrolment ID as a 28-digit identification number.
PAN-Aadhaar linking requirements
For persons subject to the linking requirement, the notified deadline for general linking was 30 June 2023. From 1 July 2023, PANs of persons who were required to link but did not do so became inoperative under the applicable rules. Linking can generally be completed subsequently after payment of the prescribed fee, where applicable, and compliance with portal requirements.
The rules have changed over time, including rules for newly allotted PANs and particular categories of persons. The relevant date and procedure should be checked on the Income Tax e-Filing Portal.
Who may be exempt?
Subject to the precise terms of the applicable notification, the commonly notified exempt categories include certain individuals residing in Assam, Jammu and Kashmir or Meghalaya; non-residents under the Income-tax Act; persons aged 80 years or more during the relevant previous year; and persons who are not citizens of India. These categories are not a blanket exemption from every PAN, identification or reporting obligation.
Consequences of an inoperative PAN
An inoperative PAN is not the same as cancellation of PAN. Under the applicable rules, consequences may include:
- Higher tax deduction at source or tax collection at source where the law requires it.
- Delays or restrictions affecting refunds and interest on refunds during the period of inoperability.
- Difficulty completing transactions for which an operative PAN is required.
Consequences and relief may differ depending on the date, transaction, and applicable notifications. For example, a higher TDS/TCS rate is not automatically imposed on every payment solely because a PAN is inoperative; the relevant statutory provision and any relaxation must be considered.
How to check PAN-Aadhaar status or complete linking
- Open the official Income Tax e-Filing Portal.
- Use the portal's Link Aadhaar Status service to verify the current status.
- If linking is required and not completed, follow the Link Aadhaar service instructions, including fee payment if applicable.
- Check whether your PAN and Aadhaar details match; resolve name, date-of-birth or other data mismatches through the appropriate official channel.
- Retain the acknowledgement and check the status again after processing.
Do not enter Aadhaar or PAN details into unofficial sites. For Aadhaar corrections and enrolment, use the Unique Identification Authority of India (UIDAI).
Frequently asked questions
Is PAN-Aadhaar linking mandatory for everyone?
No. The obligation depends on statutory eligibility and notified exemptions. A person claiming an exemption should confirm that the relevant notification applies.
Does an inoperative PAN mean the number is permanently deleted?
No. Inoperability is a compliance status and may be reversed by completing the prescribed process.
Can an Aadhaar enrolment ID always be used instead of an Aadhaar number?
No. Although the original text of Section 139AA contained an enrolment-ID proviso, later legislative changes and current procedures must be checked before relying on it.
