Section 158BFA of the Income-tax Act: Levy of Interest and Penalty in Block Assessments
Section 158BFA governs interest for failure to submit a block assessment return within the prescribed time and penalties relating to undisclosed income. Its application depends on the date of search, the governing statute and the relevant transitional provisions.
Meaning and statutory context
Block assessment is a special assessment mechanism for undisclosed income identified following a search or requisition. Under the revived Chapter XIV-B of the 1961 Act, Section 158B defines relevant terms, Section 158BA deals with assessment, Section 158BB with computation, and Section 158BC with procedure. Section 158BF excludes specified ordinary interest and penalty provisions for block-period undisclosed income, while Section 158BFA prescribes its own consequences.
Interest under Section 158BFA(1)
For searches initiated or requisitions made on or after 1 September 2024 under the revived 1961 Act framework, failure to furnish the required return of undisclosed income within the time specified in a notice under Section 158BC(1)(a), or failure to furnish it at all, attracts simple interest at 1.5% per month or part of a month on tax on undisclosed income determined under Section 158BC(1)(c). The period runs from the day immediately after the notice deadline to completion of the block assessment.
The statutory calculation is based on the assessed tax and the number of months or parts thereof. Interest should not be confused with the separate penalty under subsection (2).
Penalty under Section 158BFA(2)
Under the revived framework, the Assessing Officer or Commissioner (Appeals) may direct payment of a penalty equal to 50% of the tax leviable on undisclosed income determined in the block assessment, subject to the statutory provisos and procedural protections.
Conditions for protection from penalty
The first proviso provides protection where all prescribed conditions are fulfilled:
- The assessee furnishes the return required under Section 158BC(1)(a).
- Tax payable on that return is paid, or seized money is offered for adjustment against the tax.
- Evidence of tax payment accompanies the return.
- No appeal is filed against the assessment of the income disclosed in that return.
The protection also refers to specified penalties under Sections 271AAD(1), 271D, 271DA and 271E for the block period. Where assessed undisclosed income exceeds the income shown in the return, the second proviso preserves penalty exposure on the excess portion.
Procedural safeguards and limitation under Section 158BFA(3)
An assessee must be given a reasonable opportunity of being heard before penalty is imposed. Under the revised provision, specified lower-ranking authorities require prior approval of the prescribed superior authority when the penalty exceeds Rs. 2 lakh. Clauses (c) to (e) prescribe limitation rules for appeal, revision and other cases; statutory exclusions can affect the calculation, including periods of court-ordered stay. The exact deadline must be calculated from the relevant proceedings and receipt of appellate orders.
Under subsection (4), where an income-tax authority other than the Assessing Officer passes a penalty order, a copy must be sent to the Assessing Officer.
Earlier search cases: historical Section 158BFA
For searches under the earlier Chapter XIV-B framework, the historical provision applied to relevant searches initiated from 1 January 1997. It prescribed interest at 1% per month or part thereof for late filing or non-filing of the block return. The penalty range was 100% to 300% of the tax on assessed undisclosed income, subject to the then applicable provisos. Those figures are historical and must not be substituted for the revised post-September 2024 framework.
Historical subsection (3) also prescribed a hearing, approval requirements, specific limitation rules, exclusions and a restriction concerning searches initiated after 30 June 1995 but before 1 January 1997. Legislative amendments and their effective dates must be checked when examining an older assessment.
Section 298 of the Income-tax Act, 2025
Section 298 is the corresponding provision concerning levy of interest and penalty in specified block assessment cases under the Income-tax Act, 2025. For matters governed by the 2025 Act, consult the enacted provision and applicable amendments rather than automatically applying Section 158BFA numbering. Transitional and savings provisions determine which statute governs a particular search and proceeding.
