Section 206CB of the Income-tax Act, 1961: Processing of TCS Statements
Section 206CB prescribed the procedure for processing statements of tax collected at source (TCS), including correction statements, determining apparent errors, interest, late filing fees, amounts payable and refunds.
Meaning and scope of Section 206CB
Under Section 206CB(1), a TCS statement or correction statement furnished by a person collecting tax under Section 206C was processed through specified statutory adjustments. A collector is the person responsible for collecting tax at source under the applicable provisions. A correction statement is a revised statement furnished to correct particulars in an earlier TCS statement.
Processing procedure under Section 206CB(1)
- Clause (a): Compute the sums collectible after adjusting arithmetic errors and incorrect claims apparent from information in the statement.
- Clause (b): Compute applicable interest based on the sums collectible as computed in the statement.
- Clause (c): Compute any late filing fee in accordance with Section 234E.
- Clause (d): Determine the net amount payable or refundable after taking account of payments under Sections 206C and 234E and other payments towards tax, interest or fees.
- Clause (e): Prepare or generate an intimation stating the amount payable or refund due.
- Clause (f): Grant any refund determined to be due to the collector.
What is an incorrect claim apparent from the statement?
The Explanation to Section 206CB(1) covered two categories: an entry inconsistent with another entry in the same statement, and a TCS rate claim not in accordance with the Act. These are statement-based adjustments and should not be confused with a full assessment of unrelated factual disputes.
Time limit for processing intimation
The proviso to Section 206CB(1) stated that no intimation could be sent after one year from the end of the financial year in which the statement was filed. For example, for a statement filed during financial year 2024-25, the statutory one-year period would ordinarily end on 31 March 2026, subject to any applicable special provision.
Centralised processing scheme
Section 206CB(2) authorised the Central Board of Direct Taxes (CBDT) to make a scheme for centralised processing of TCS statements, to determine amounts payable or refunds expeditiously.
Interest, late fees and correction statements
Section 234E of the 1961 Act provided for a fee of Rs. 200 per day for delay in furnishing specified TDS or TCS statements, subject to the statutory cap. Interest and other consequences depend on the nature and period of default. From 1 April 2025, the time limit for submitting a correction statement under Section 206C(3B) was generally six years from the end of the financial year in which the statement was required to be furnished.
Section 399 of the Income-tax Act, 2025
Section 399 provides a unified processing mechanism for statements of tax deducted at source and tax collected at source, including correction statements. It covers arithmetic errors, incorrect apparent claims, interest, fees, reconciliation of payments, generation of intimations and grant of refunds. Under Section 399(2), the intimation is to be sent within one year from the end of the tax year in which the statement is filed. Section 399(3) permits a centralised processing scheme.
