Section 270A Income Tax Act: Under-Reporting and Misreporting Penalty

Section 270A of the Income-tax Act, 1961 deals with penalties for under-reporting and misreporting of income. It distinguishes ordinary under-reporting from specified acts of misreporting and provides separate penalty rates.

Key rule: The statutory penalty is generally 50% of tax payable on under-reported income, or 200% where the under-reporting results from misreporting. Applicable exclusions and procedural safeguards must be considered.

Misreporting of income200% of tax payable on under-reported income270A(8) and (9)

What counts as misreporting?

Section 270A(9) specifies six situations: suppression or misrepresentation of facts; failure to record investments; unsupported expenditure claims; false entries in books; omission of receipts affecting taxable income; and failure to report specified international or domestic transactions subject to Chapter X.

Exclusions and safeguards

Under Section 270A(6), qualifying bona fide explanations with full material disclosure, certain estimated additions, specified transfer-pricing adjustments, and income covered by Section 271AAB are excluded from under-reported income. An addition in assessment does not, by itself, establish that a particular misreporting category applies.

How the tax and penalty are calculated

Sub-sections (3) and (10) govern the amount of under-reported income and the tax attributable to it. The computation depends on the original return or preceding order, whether an assessment is the first assessment, any losses, and applicable minimum alternate tax provisions. The statutory formula must be used rather than multiplying the income addition directly by 50% or 200%.

Immunity, appeals and the 2026 transition

Section 270AA governs applications for immunity subject to the conditions applicable to the relevant assessment year and date. Legislative changes in 2026 affect immunity and penalty procedure. The Income-tax Act, 2025, effective from 1 April 2026, contains the corresponding penalty provision in Section 439. For earlier assessment years, check the continuing application and amended text of the Income-tax Act, 1961.
