Section 35CCA: Deduction for Rural Development Payments under the Income-tax Act

Section 35CCA of the Income-tax Act, 1961 provides for a deduction for specified payments supporting rural development programmes and notified funds, subject to eligibility and documentation requirements. This guide explains the statutory clauses, approval rules, restrictions and treatment under the newer income-tax framework.

Important for 2026: Section 35CCA is a provision of the Income-tax Act, 1961. The Income-tax Act, 2025 applies from 1 April 2026. For a current-year claim, verify the relevant provisions of the 2025 Act, commencement and transitional rules, and any applicable notifications. This article preserves the text of Section 35CCA for historical and pending assessments; it does not assume that its deduction is automatically available under the new Act.

What is Section 35CCA?

Section 35CCA allows an assessee to deduct qualifying expenditure incurred by way of payment to specified associations, institutions or notified funds. It concerns eligible rural development and poverty-eradication programmes rather than a general deduction for every charitable contribution.

Assessee means a person liable to pay tax or otherwise covered by the statutory definition. Previous year is the financial period to which income or expenditure relates under the 1961 Act. Prescribed authority means the authority designated by the applicable income-tax rules for the relevant approval or authorisation.

Section 35CCA(1): Which payments qualify?

ClauseRecipient or purposeKey condition
(a)Association or institution undertaking an approved rural development programmeProgramme approval and the special historical certificate requirements under subsection (2)
(b)Association or institution training people to implement rural development programmesHistorical approval and training commencement requirements under subsection (2A)
(c)Rural development fund set up and notified by the Central GovernmentRelevant government notification and qualifying payment
(d)National Urban Poverty Eradication Fund set up and notified by the Central GovernmentRelevant government notification and qualifying payment

Under the section, a qualifying deduction is based on the amount paid during the previous year, subject to the remaining conditions. The historical certificate rules in clauses (a) and (b) refer to dates in 1983 and must not be treated as an open-ended approval process for new programmes.

Section 35CCA(2), (2A) and (2B): Certificates and approvals

Subsection (2): Rural development programmes

For payments covered by clause (1)(a), the donor must furnish a certificate stating that the programme was approved before 1 March 1983. For payments made after 28 February 1983, the certificate must also address the prescribed construction, road, well, tube-well, plant or machinery work and its commencement before 1 March 1983.

Subsection (2A): Training institutions

For payments under clause (1)(b), the certificate must confirm that the institution was approved before 1 March 1983 and that training for rural development implementation began before that date.

Subsection (2B): Written authorisation

An institution may issue certificates of the nature referred to in subsections (2) and (2A) only if it has written authorisation from the prescribed authority.

Subsequent withdrawal of approval

The explanation following subsection (2A) protects a qualifying deduction from being denied merely because approval was withdrawn after the payment. It does not excuse a failure to meet the original conditions when the payment was made.

Section 35CCA(3): No double deduction

Once a deduction has been claimed and allowed under Section 35CCA, the same expenditure cannot also be deducted under Sections 35C, 35CC, 80G or another provision of the Income-tax Act, 1961, whether in the same assessment year or a different one.

Section 80G is a separate provision concerning eligible donations. A payment must be evaluated under the correct provision and cannot be counted twice.

Illustration: How the deduction operated

Assume an assessee made a payment of Rs. 1,00,000 in a year governed by the 1961 Act to a properly notified fund falling under Section 35CCA(1)(c). If the applicable statutory conditions were satisfied, Section 35CCA provided for a deduction of Rs. 1,00,000. The assessee could not claim the same Rs. 1,00,000 again under Section 80G.

This is an illustration of the historical provision, not confirmation that a particular fund or payment qualifies in tax year 2026-27.

Practical verification before claiming

  • Identify the correct tax year and governing Act.
  • Check the recipient's legal status, programme approval or fund notification.
  • Obtain proof of payment and, where required, the prescribed certificate and authorisation.
  • Check whether the same payment has already been deducted elsewhere.
  • Retain official notifications, correspondence and accounting records for assessment proceedings.

(2B) No certificate of the nature referred to in sub-section (2) or sub-section (2A) shall be issued by any association or institution unless such association or institution has obtained from the prescribed authority authorisation in writing to issue certificates of such nature.

(3) Where a deduction under this section is claimed and allowed for any assessment year in respect of any expenditure referred to in sub-section (1), deduction shall not be allowed in respect of such expenditure under section 35C or section 35CC or section 80G or any other provision of this Act for the same or any other assessment year. --------------------

Frequently asked questions

What is Section 35CCA of the Income-tax Act, 1961?

It provided a deduction for qualifying payments to specified rural development associations or institutions, notified rural development funds, and the National Urban Poverty Eradication Fund, subject to statutory conditions.

Is a donation to any rural development NGO automatically deductible?

No. The recipient, programme, approvals or notifications, and documentary conditions must meet the applicable law. A general charitable donation is not automatically eligible under Section 35CCA.

Can the same payment be deducted under Section 35CCA and Section 80G?

No. Section 35CCA(3) prohibits a second deduction of the same expenditure under Section 80G or another provision.

What happens if an institution loses approval after payment?

The explanation to Section 35CCA(2A) provides that a qualifying deduction is not denied merely because the relevant approval is subsequently withdrawn. The original eligibility conditions must still have been met.

How does the Income-tax Act, 2025 affect claims?

For tax years beginning on or after 1 April 2026, consult the Income-tax Act, 2025 and applicable transition provisions rather than assuming a deduction under the 1961 Act continues unchanged.
