Income-tax Act, 1961 | Section 80GGA

Section 80GGA Deduction: Scientific Research and Rural Development Donations

Section 80GGA of the Income-tax Act, 1961 provided a deduction for eligible monetary donations supporting approved scientific research, social science or statistical research, and specified rural development programmes or funds. Unlike the ordinary charitable donation deduction under Section 80G, this provision has special conditions and excludes taxpayers whose gross total income includes business or professional income.

Law applicable in 2026: The Income-tax Act, 2025 came into force on 1 April 2026. The discussion of Section 80GGA below concerns years governed by the Income-tax Act, 1961 and relevant transitional or saved matters. The archived extract is not a fully updated consolidated statute. Verify the corresponding rules for tax years under the 2025 Act, including any changes to eligibility, approved recipients and the tax regime.

What is Section 80GGA?

Section 80GGA(1) allows eligible donations listed in Section 80GGA(2) to be deducted in computing total income, subject to the conditions of the section. Qualifying recipients must have the prescribed approvals or notifications in force for the relevant contribution. A donation to an unapproved organisation is not deductible merely because its activities are scientific or charitable.

Who can claim the deduction?

Section 80GGA(3) disallows the deduction if the assessee's gross total income includes income chargeable under the head "Profits and gains of business or profession". It is therefore primarily relevant to eligible individuals and other assessees without such business or professional income. The test concerns the composition of gross total income, not simply the taxpayer's occupation or the existence of a business registration.

For years governed by the 1961 Act, eligibility also depends on the chosen tax regime. Under the concessional regime in Section 115BAC, this deduction is generally not available to individuals. Taxpayers should verify the relevant statutory year and return requirements.

Deduction amount and cash-payment limit

Qualifying payments were generally deductible at 100% of the eligible amount under the applicable Section 80GGA provisions, subject to the taxpayer's gross total income and other restrictions. Section 80GGA(2A) disallows deduction for any sum exceeding Rs. 10,000 unless it is paid by a mode other than cash. Bank transfer, cheque or other traceable permitted non-cash payment methods help establish proof of payment.

Example: An eligible salaried taxpayer with sufficient gross total income donates Rs. 25,000 by bank transfer to a qualifying research institution approved for the relevant period. Subject to all other statutory requirements and tax-regime conditions, the potential Section 80GGA deduction is Rs. 25,000. If the same amount is donated in cash, Section 80GGA(2A) prevents the deduction.

Approval, certificates and withdrawn approvals

For scientific, social science and statistical research, verify the recipient's approval under the corresponding clauses of Section 35. For qualifying rural development contributions, retain the prescribed certificate contemplated by Section 35CCA. The historical explanations in Section 80GGA protect qualifying contributions from being denied merely because the recipient's approval was withdrawn after the payment; this does not cure an absence of approval at the relevant time or other non-compliance.

Section 80GGA versus Section 80G and Section 35

Section 80G concerns specified charitable donations, which may attract a 50% or 100% deduction and, in some cases, an adjusted-income ceiling. Section 80GGA addresses the specified research and development contributions and excludes business-income taxpayers. Section 35 contains separate provisions relating to scientific research expenditure and contributions; it is not interchangeable with Section 80GGA. Section 80GGA(4) also prevents claiming a second deduction for the same qualifying payment under another provision of the 1961 Act.

Records and practical compliance

  • Confirm the recipient's legal name, PAN and applicable approval or notification at the time of payment.
  • Retain bank records, donation receipt, acknowledgment and prescribed certificates where required.
  • Check that the contribution is within an eligible category and is not a non-qualifying historical project.
  • Confirm the applicable tax regime and avoid claiming the same payment under two provisions.
  • Review return-filing instructions and any reporting requirements on the official e-Filing Portal.

Income-tax Act, 2025 and historical amendments

Section 80GGA originated in the Income-tax Act, 1961 and underwent several amendments. Some clauses in the original text expressly apply only to older years; the Section 35AC framework also has a sunset. The Income-tax Act, 2025 applies from 1 April 2026, so deductions for later tax years must be tested against that Act and the applicable rules, rather than assuming the historic section number or benefit continues unchanged.

Frequently asked questions

Who can claim a deduction under Section 80GGA?

Under the Income-tax Act, 1961, eligible taxpayers whose gross total income does not include income chargeable under profits and gains of business or profession may claim qualifying donations, subject to all conditions.

Is there a monetary ceiling on the Section 80GGA deduction?

The eligible amount is generally 100 percent of the qualifying donation under the applicable 1961 Act provisions, without a separate overall rupee cap under this section, subject to the gross-total-income limitation and other conditions.

Can I donate more than Rs. 10,000 in cash?

Under Section 80GGA(2A), a donation exceeding Rs. 10,000 is not deductible unless paid by a mode other than cash. Separate qualifying donations and their circumstances must be evaluated under the governing law.

Can business-income taxpayers claim Section 80GGA?

No. Section 80GGA(3) disallows this deduction if gross total income includes income chargeable under the head profits and gains of business or profession.

Is Section 80GGA available under the new tax regime?

Under the 1961 Act, the Section 80GGA deduction is generally unavailable to individuals opting for the concessional regime under Section 115BAC. For tax years starting on or after 1 April 2026, consult the Income-tax Act, 2025 and the applicable tax regime.
