Income-tax Act, 1961 | Historical industrial incentives

Section 80-I: Deduction for Profits from Industrial Undertakings, Ships and Hotels

Section 80-I of the Income-tax Act, 1961 provided a historical profit-linked deduction for specified industrial undertakings, ships, hotel businesses and repairs to ocean-going vessels or other powered craft. The relief was subject to strict commencement windows, formation requirements, eligible activities and limits on the number of assessment years.

Current-law position: Section 80-I is a legacy incentive for undertakings and activities commencing in the prescribed historical periods. It should not be presented as an open-ended deduction for businesses established today. The Income-tax Act, 2025 applies from 1 April 2026; the old Section 80-I numbering and historical relief do not establish eligibility under the new statute. This page retains the supplied 1961 Act text for research and older-year proceedings.

What was Section 80-I?

Section 80-I, introduced with effect from 1 April 1981, allowed qualifying taxpayers to deduct a percentage of profits and gains derived from specified eligible activities when computing total income. It covered qualifying manufacturing or producing undertakings and cold-storage plants, certain ships, approved hotels and approved vessel-repair businesses. The undertaking or business had to meet the conditions applicable to its category and starting year.

The deduction was based on eligible profits, not gross turnover, investment or the full value of an industrial project. The statutory commencement windows are historical; opening a new factory, hotel or shipping business now does not by itself qualify for Section 80-I.

Historical Section 80-I deduction rates

Category under the supplied statutory textGeneral deductionRelevant company rate
Eligible industrial undertaking, ship or hotel under subsection (1)20% of eligible profits25% of eligible profits
Eligible undertaking, ship or hotel commencing on or after 1 April 1990 but before 1 April 1991 under subsection (1A)25% of eligible profits30% of eligible profits
Approved business repairing ocean-going vessels or powered craft20% under subsection (1), subject to applicable conditionsCheck the precise applicable provision; the company-rate proviso identifies industrial undertakings, ships and hotels

Rates depend on the precise category, year and statutory text in force for the assessment year. A taxpayer must not combine the general rate with the special subsection (1A) rate.

Eligibility requirements by business category

1. Industrial undertakings and cold-storage plants: subsection (2)

  • The undertaking was not formed by splitting up or reconstructing an existing business, subject to the statutory exception linked to Section 33B.
  • It was not formed by transferring previously used machinery or plant, subject to the statutory explanations and the limited 20% tolerance.
  • It manufactured or produced eligible articles or things, or operated cold-storage plants, within the prescribed historical commencement window. The Eleventh Schedule restriction and small-scale undertaking exception were relevant.
  • Where manufacturing or production was involved, it ordinarily employed at least 10 workers with power or at least 20 workers without power.

2. Ships: subsection (3)

The ship had to be owned by an Indian company, wholly used in its business, not previously owned or used in Indian territorial waters by an Indian resident, and first brought into use within the prescribed historical period.

3. Hotel businesses: subsection (4)

The hotel business was subject to restrictions on splitting or reconstruction, transfer of previously used hotel buildings or plant, ownership by an Indian registered company with paid-up capital of at least Rs. 5,00,000, Central Government approval and the historical operating-start window. The original text below should be consulted for the exact year-specific conditions.

4. Repairs to ocean-going vessels and other powered craft: subsection (4A)

The business had to be carried on by an Indian company, satisfy the new-business and machinery restrictions, commence the relevant repair work after 31 March 1983 and before 1 April 1988, and have the prescribed Central Government approval.

How many assessment years did the deduction run?

Under subsection (5), the usual period was the initial assessment year plus seven immediately succeeding assessment years (eight assessment years in total). The historical text prescribed category-specific variations:

  • Co-operative society: Initial year plus nine succeeding years, ordinarily ten years in total.
  • Vessel-repair business: Initial year plus four succeeding years, ordinarily five years in total.
  • Specified industrial undertakings, ships and hotels commencing between 1 April 1990 and 31 March 1991: Initial year plus nine succeeding years, ordinarily ten years in total.
  • Co-operative society within that special commencement group: Initial year plus eleven succeeding years, ordinarily twelve years in total.

The initial assessment year was linked to the year the undertaking began manufacture or production or cold storage, the ship was first used, the hotel started functioning, or the qualifying vessel-repair work commenced.

Computation, audit and anti-avoidance safeguards

Separate-source computation: subsection (6)

For subsequent years, eligible profits were determined on the statutory assumption that the qualifying undertaking, ship or business was the assessee's only source of income during the relevant period. The rule required careful computation and could affect how losses and earlier years were considered.

Audit report: subsection (7)

For an eligible industrial undertaking owned by a taxpayer other than a company or co-operative society, the provision required an audit of the undertaking's accounts by the specified accountant and furnishing the prescribed report with the return, as applicable to the historical assessment year.

Transfers at market value: subsection (8)

Where goods were transferred between the eligible business and another business of the same taxpayer at a non-market price, profits for the deduction could be recomputed as if the transfer occurred at market value. The Assessing Officer could use a reasonable basis in cases of exceptional difficulty.

Excess profits from close connections: subsection (9)

Where arrangements with a connected person produced more than ordinary profits, the Assessing Officer could determine the reasonable amount of profits attributable to the qualifying business for deduction purposes.

Government exclusion power: subsection (10)

The Central Government could, by Gazette notification following the required inquiry, exclude specified classes of industrial undertakings from the benefit from a notified date.

Important terms and statutory references

Industrial undertaking: For this provision, eligibility depended on the manufacturing, production or cold-storage activity and all conditions in subsection (2), not merely on describing a business as industrial.

Small-scale industrial undertaking: Subsection (2), Explanation 3 adopted the definition in the historical Section 80HHA(8) Explanation; the applicable historical investment and classification rules require year-specific verification.

Previously used machinery: Explanation 1 prescribed conditions for imported machinery used outside India; Explanation 2 deemed the restriction satisfied where transferred used plant or machinery did not exceed 20% of the total value of plant and machinery used in the business.

Market value: Subsection (8) defined it as the price the goods would ordinarily fetch on sale in the open market.

Eleventh Schedule: The historical schedule listed articles or things relevant to restrictions under subsection (2); an exception applied to qualifying small-scale undertakings.

Illustrative historical calculation

Assume a qualifying non-company industrial undertaking earned Rs. 12,00,000 of eligible profits in a year to which the general 20% rate applied. The starting deduction would be Rs. 2,40,000, subject to the actual assessment-year law, profit computation, available gross total income and compliance conditions. For a qualifying company under the general 25% rate, the corresponding starting figure would be Rs. 3,00,000. These figures are examples of historical rules, not current-year deduction claims.

Relationship with other industrial incentives

Section 80-I should be distinguished from the separate incentive provisions of Sections 80-IA, 80-IAB and 80-IAC, each of which had or has its own statutory scope, dates and conditions. The introduction of later incentives did not make the original Section 80-I universally available for newly established undertakings.

(6) Notwithstanding anything contained in any other provision of this Act, the profits and gains of an industrial undertaking or a ship or the business of a hotel 10 or the business of repairs to ocean-going vessels or other powered craft to which the provisions of sub-section (1) apply shall, for the purposes of determining the quantum of deduction under sub-section (1) for the assessment year immediately succeeding the initial assessment year or any subsequent assessment year, be computed as if such industrial undertaking or ship or the business of the hotel 10 or the business of repairs to ocean-going vessels or other powered craft were the only source of income of the assessee during the previous years relevant to the initial assessment year and to every subsequent assessment year up to and including the assessment year for which the determination is to be made.

(7) Where the assessee is a person other than a company or a co-operative society, the deduction under sub-section (1) from profits and gains derived from an industrial undertaking shall not be admissible unless the accounts of the industrial undertaking for the previous year relevant to the assessment year for which the deduction is claimed have been audited by an accountant, as defined in the Explanation below sub-section (2) of section 288, and the assessee furnishes, along with his return of income, the report of such audit in the prescribed form duly signed and verified by such accountant.

Provided that where, in the opinion of the 14 Assessing Officer, the computation of the profits and gains of the industrial undertaking or the business of the hotel or the operation of the ship 13 or the business of repairs to ocean-going vessels or other powered craft in the manner hereinbefore specified presents exceptional difficulties, the 14 Assessing Officer may compute such profits and gains on such reasonable basis as he may deem fit.

Explanation.-In this sub-section, "market value", in relation to any goods, means the price that such goods would ordinarily fetch on sale in the open market.

(9) Where it appears to the 14 Assessing Officer that, owing to the close connection between the assessee carrying on the business of the industrial undertaking or the hotel or the operation of the ship 13 or the business of repairs to ocean-going vessels or other powered craft to which this section applies and any other person, or for any other reason, the course of business between them is so arranged that the business transacted between them produces to the assessee more than the ordinary profits which might be expected to arise in the business of the industrial undertaking or the hotel or the operation of the ship 13 or the business of repairs to ocean-going vessels or other powered craft, the 14 Assessing Officer shall, in computing the profits and gains of the industrial undertaking or the hotel or the ship 13 or the business of repairs to ocean-going vessels or other powered craft for the purposes of the deduction under this section, take the amount of profits as may be reasonably deemed to have been derived therefrom.

(10) The Central Government may, after making such inquiry as it may think fit, direct, by notification in the Official Gazette, that the exemption conferred by this section shall not apply to any class of industrial undertakings with effect from such date as it may specify in the notification.

Frequently asked questions

Can a factory newly established in 2026 claim Section 80-I?

No deduction should be claimed merely by invoking this historical section. Its eligibility windows concern earlier decades. Any current incentive must be independently established under the legislation applicable to the tax year.

Was the Section 80-I deduction 20% or 25%?

Under the general historical rule it was 20%, with a 25% rate for specified company profits. A special rule prescribed 25% and 30% respectively for qualifying activities commencing during the stated 1990-91 window.

Were hotel businesses eligible?

Yes, but only approved hotel businesses meeting the historical company-ownership, capital, formation and commencement requirements.

Could previously used machinery be included?

There were statutory exceptions, including qualifying imported machinery previously used abroad and a 20% value tolerance for certain transferred used machinery.

Did every undertaking receive the deduction for eight years?

No. The general eight-year period was modified for co-operative societies, vessel-repair businesses and certain activities commencing in the special 1990-91 window.
