Section 80PA: Tax Deduction for Eligible Producer Companies

Section 80PA of the Income-tax Act, 1961 provided a 100% deduction of profits and gains attributable to specified agricultural activities of qualifying Producer Companies with annual turnover below Rs. 100 crore, subject to the assessment-year limits and other statutory conditions.

Important 2026 legal context: The original webpage reproduces a historical version of Section 80PA ending with assessment years beginning before 1 April 2025. That text should not be relied upon without checking later Finance Acts and the version applicable to the assessment year. The Income-tax Act, 2025 came into effect on 1 April 2026; consult its operative provisions and transitional rules for current tax years. This article distinguishes the original text from later-law verification.

What is the Section 80PA deduction?

Under subsection (1), a qualifying Producer Company whose gross total income includes profits and gains derived from an eligible business may deduct 100% of the profits and gains attributable to that business. It is a profit-linked deduction, not an exemption of all turnover, receipts or every activity conducted by the company.

The original statutory extract states that the company's total turnover must be less than Rs. 100 crore in the relevant previous year. This is a strict 'less than' threshold, not 'up to and including' Rs. 100 crore. The statutory year-of-availability window must be verified against amendments before filing.

Who can claim the deduction?

ConditionWhat it means
Entity typeThe assessee must be a Producer Company within the applicable company-law definition, not merely any private company, partnership, co-operative society or informal farmers' group.
TurnoverTotal turnover must be below Rs. 100 crore for the previous year, under the reproduced historical provision.
Eligible incomeProfits and gains must be attributable to the specific member-related agricultural businesses in the Explanation.
Relevant tax yearThe deduction is available only for assessment years permitted by the law in force for the claim.
ComputationDeduction is subject to Chapter VI-A rules and adjustments for other applicable deductions.

Three eligible businesses under the statutory Explanation

1. Marketing agricultural produce grown by members

The company markets agricultural produce actually grown by its members. The member-origin requirement matters: income from buying and reselling unrelated third-party produce is not automatically covered merely because the company is registered as a Producer Company.

2. Supplying agricultural inputs to members

The company purchases agricultural implements, seeds, livestock or other articles intended for agriculture for supply to its members. Ordinary trading in goods to non-members should not automatically be classified as eligible income.

3. Processing agricultural produce of members

The company processes agricultural produce of its members. Records should demonstrate the connection between the produce processed, the members who supplied it and the income earned. Activities outside the statutory description require separate evaluation.

How is the deduction calculated?

Illustration: Assume a qualifying Producer Company has total turnover of Rs. 75 crore for an assessment year in which Section 80PA is legally available. Its eligible profits from marketing produce grown by members are Rs. 12 lakh, and its separate non-eligible trading profits are Rs. 3 lakh. Before any adjustments for other deductions and Chapter VI-A limitations, the illustrative Section 80PA deduction is Rs. 12 lakh, not Rs. 15 lakh and not a percentage of turnover.

Overlapping deductions: Subsection (2) provides that where another Chapter VI-A deduction also applies, Section 80PA is calculated with reference to the eligible income included in gross total income after reducing it by deductions under other applicable provisions. The same income should not receive duplicated relief.

Important statutory and legal definitions

Producer Company: The original Section 80PA Explanation cross-refers to Section 581A(l) of the Companies Act, 1956. Producer-company law was subsequently carried into Chapter XXIA of the Companies Act, 2013, inserted by the Companies (Amendment) Act, 2020. For modern company-law compliance, consult the current Companies Act and applicable saving and transition provisions rather than relying solely on the 1956 cross-reference.

Member: The historical text refers to Section 581A(d) of the Companies Act, 1956. Membership and related eligibility must be determined under the applicable producer-company legislation and the company's records.

Eligible business: For the purposes of this provision, the three categories are member-grown produce marketing, agricultural input procurement for members and processing of members' agricultural produce.

Previous year and assessment year: Under the 1961 Act, a previous year was the financial year in which income was earned, and the assessment year was the following tax assessment period. The Income-tax Act, 2025 uses a tax-year framework; apply the relevant legislation for the period concerned.

Documents and compliance considerations

Maintain incorporation and producer-company status records, the register of members, member-wise procurement and sale invoices, agricultural produce and processing records, separate ledgers for eligible and ineligible activities, turnover calculations, audited financial statements and tax-return working papers. The deduction cannot be assumed solely from a company's name or its agricultural business classification.

Section 80PA compared with Section 80P

Section 80PA concerned qualifying Producer Companies, which are companies formed under producer-company legislation. Section 80P concerned specified income of co-operative societies and included separate restrictions on co-operative banks. The entity type, activities and tax-year rules differ; these provisions are not interchangeable.

Relevant legislative history and current-law checks

Section 80PA was inserted by the Finance Act, 2018 with effect from 1 April 2019. The supplied historical transcription contains a sunset tied to assessment years commencing before 1 April 2025. Before relying on that end date or claiming relief for a later year, check the subsequently amended legislation, Finance Acts and the Income-tax Act, 2025. An older online transcription is not itself proof of the currently operative end date.

No. The historical provision specifically applies to a qualifying Producer Company. A co-operative, trust or other farmers' organisation must consider the tax provisions appropriate to its legal structure.

What was the deduction rate?

It was 100% of qualifying profits and gains attributable to the three specified eligible activities, subject to the turnover threshold and statutory tax-year limits.

Does the deduction cover all sales by a Producer Company?

No. Eligible profits must arise from the statutory member-related activities. Income from other business operations is not automatically covered.

Can a Producer Company with turnover of exactly Rs. 100 crore qualify?

Under the original wording, no: it requires turnover less than Rs. 100 crore.

Can Section 80PA be claimed for tax year 2026-27?

Do not rely on the historical Section 80PA wording for a current-year claim. Check the operative Income-tax Act, 2025, the relevant deduction provisions and transition rules before making a claim.
