Section 36 CPC - Application to Orders

Section 36 of the Code of Civil Procedure, 1908 (CPC) makes the rules for executing civil court decrees applicable, as far as appropriate, to the execution of court orders, including orders directing payment.

Section 36 CPC - Statutory Provision

36. Application to orders. - The provisions of this Code relating to the execution of decrees (including provisions relating to payment under a decree) shall, so far as they are applicable, be deemed to apply to the execution of orders (including payment under an order).

This provision appears in Part II (Execution) of the CPC. Its present central wording was substituted by Section 16 of the Code of Civil Procedure (Amendment) Act, 1976, effective from 1 February 1977. Consult the official India Code text of the CPC for the Act and its schedules.

Meaning and Scope of Section 36

The purpose of Section 36 is to provide a procedural bridge between the execution of decrees and the execution of orders. Where an order is capable of execution, the relevant machinery used for executing decrees can be applied to it, subject to the nature of the order and any specific governing provision.

  • Application to orders: Execution rules are not restricted to decrees; they can also govern enforceable orders.
  • Payment under an order: The section expressly includes provisions concerning payments directed by a court order.
  • So far as applicable: The execution procedure must fit the particular order; Section 36 does not make every procedural direction independently executable.
  • Subject to other provisions: Special procedures, limitations, stays and applicable court rules must still be observed.

Relevant Legal Definitions

Decree - Section 2(2) CPC

A decree is the formal expression of an adjudication which, so far as regards the court expressing it, conclusively determines the rights of the parties concerning all or any of the matters in controversy in a suit. The statutory definition includes certain deemed decrees and excludes matters specified in Section 2(2).

Order - Section 2(14) CPC

An order is the formal expression of any decision of a civil court which is not a decree. Section 36 addresses execution of such orders where execution provisions can appropriately operate.

Execution - Part II and Order XXI CPC

Execution is the court-supervised process of enforcing an executable decree or order. Part II and Order XXI of the CPC contain important rules on execution, including payment, applications, attachment and other enforcement processes.

How a Court Order May Be Executed

  1. Identify the order: Check its operative directions and whether it is enforceable by execution.
  2. Check compliance and stay: Confirm whether the required act or payment remains outstanding and whether any stay or other restriction applies.
  3. Choose the competent court: Apply the relevant provisions on the executing court, including Sections 37 and 38 CPC where appropriate.
  4. File the proper application: Follow the applicable provisions of Order XXI, including requirements for execution applications where relevant.
  5. Seek suitable relief: The court may use an execution method permitted by law and suitable for the particular order.

Important: Section 36 does not automatically authorize attachment, arrest or any other particular enforcement measure in every case. The relief must be supported by the nature of the order and applicable statutory rules.

Illustrative Applications

Payment order: If a civil court makes an executable order directing payment of a specified amount, Section 36 can permit the applicable decree-execution provisions to be used for enforcing payment.

Costs order: Where costs are ordered and the order is executable, the relevant execution machinery may be available, subject to the specific provision under which costs were awarded.

Interim directions: A temporary injunction or other interlocutory direction may have its own enforcement mechanism, such as Order XXXIX Rule 2A. Section 36 must be read alongside those special provisions rather than treated as a substitute for them.

Frequently Asked Questions

Does Section 36 CPC apply to every court order?

No. It applies the decree-execution provisions to orders only so far as those provisions are applicable. The nature of the order and any special enforcement mechanism remain important.

Can a payment order be executed under Section 36?

Yes, where the order is executable and the relevant execution provisions apply. Section 36 expressly covers payment under an order.

Is an order the same as a decree?

No. Sections 2(2) and 2(14) CPC distinguish a decree from an order. Section 36 connects their execution procedures without eliminating that distinction.
