Meaning and scope of Rule 6G
A counterclaim is a claim raised by a defendant against the plaintiff in the same suit. Under Order VIII Rule 6A, a counterclaim operates substantially as a cross-suit and is treated as a plaint for procedural purposes. The plaintiff may file a written statement in answer to it within the period fixed by the court.
Rule 6G makes clear that the ordinary rules governing written statements apply to that reply. Thus, although the person responding is the plaintiff in the original suit, the plaintiff is defending the counterclaim and must address its allegations in the manner required by the applicable pleading rules.
Important requirements when replying to a counterclaim
- Answer the material allegations: Order VIII Rules 3, 4 and 5 require specific and non-evasive denials, subject to their terms and applicable exceptions.
- Plead special defences: Under Order VIII Rule 2, matters such as limitation, payment, release, fraud or other grounds that could surprise the opposing party should be specifically pleaded when relied upon.
- Address documents: The applicable rules concerning documents relied upon in a written statement, including Order VIII Rule 1A, should be considered.
- Observe the court's directions: Order VIII Rule 6A(3) permits a reply within the period fixed by the court. Applicable statutory deadlines, special procedural regimes and court rules must also be checked.
- Verify the pleading: The general pleading requirements of Order VI, including signature and verification, apply as relevant. Commercial disputes may also require a statement of truth and additional disclosures.
What happens if the plaintiff does not reply?
Order VIII Rule 6E provides that where a plaintiff defaults in filing a reply to the counterclaim, the court may pronounce judgment against the plaintiff in relation to the counterclaim or make another order it considers fit. This is a discretionary power, not an automatic judgment in every case.
How Rule 6G works with other CPC provisions
Order VIII Rule 6A - Counterclaim by defendant
Rule 6A establishes the right to raise a counterclaim, subject to statutory conditions, and expressly permits the plaintiff to answer it by written statement.
Order VIII Rules 3 to 5 - Denial of allegations
These provisions address the need for specific responses to allegations. A general or evasive denial may have adverse pleading consequences, subject to the court's powers and the particular facts.
Order VIII Rule 6F - Relief where set-off or counterclaim succeeds
Rule 6F allows the court to give judgment for a balance found due to either party when a set-off or counterclaim is established as a defence against the original claim.
Special position of commercial suits
For commercial disputes of a specified value, the Commercial Courts Act, 2015 introduces special amendments to the CPC, including stricter written-statement timelines and more detailed pleading and denial requirements. The applicable commercial-court provisions, court rules and directions must be considered alongside Rule 6G. The ordinary CPC timeline should not be assumed to override those special provisions.
