Text and meaning of Order XI Rule 7

Rule 7 - Certain provisions of the Code of Civil Procedure, 1908 not to apply.

For avoidance of doubt, it is hereby clarified that Order XIII Rule 1, Order VII Rule 14 and Order VIII Rule 1A of the Code of Civil Procedure, 1908 (5 of 1908) shall not apply to suits or applications before the Commercial Divisions of High Court or Commercial Courts.

The rule is part of the commercial-suits version of Order XI inserted through the Schedule to the Commercial Courts Act, 2015 (official India Code text). It does not repeal these CPC provisions for ordinary civil suits.

Which CPC provisions are excluded?

Order XIII Rule 1 - Original documents

In ordinary civil proceedings, this rule addresses the production of original documentary evidence at or before the settlement of issues. Commercial proceedings instead follow the disclosure, inspection and production framework of the substituted Order XI, subject to applicable court directions.

Order VII Rule 14 - Documents relied upon by plaintiff

Ordinarily, this rule governs documents on which a plaintiff sues or relies. In commercial suits, substituted Order XI Rule 1 prescribes a broader disclosure obligation, including relevant documents in the plaintiff's power, possession, control or custody, even when adverse to the plaintiff's case, subject to stated exceptions.

Order VIII Rule 1A - Documents relied upon by defendant

This provision ordinarily regulates documents relied upon by a defendant. In commercial litigation, the defendant's document disclosure duties are principally governed by the substituted Order XI Rule 1, including disclosure with the written statement or counterclaim, as applicable.

What applies instead in commercial suits?

Section 16 of the Commercial Courts Act, 2015 applies the CPC as amended by the Act to commercial disputes of specified value. The substituted Order XI establishes a more detailed framework:

Rule 1: Disclosure and discovery of documents, including lists, copies and declarations on oath.
Rule 2: Discovery by interrogatories, subject to court control.
Rule 3: Inspection of documents.
Rule 4: Admission and denial of documents.
Rule 5: Production of documents by a party or person.
Rule 6: Disclosure and proof-related directions concerning electronic records.
Rule 7: Exclusion of the three ordinary CPC document-production provisions identified above.

Scope and practical effect

The exclusion applies to suits and applications before Commercial Courts and Commercial Divisions of High Courts governed by the commercial-dispute procedure. It should not be understood to mean that documents need not be disclosed. On the contrary, substituted Order XI imposes specific and often more extensive obligations, and the court retains procedural powers under the applicable rules.

Whether a case is a commercial dispute depends on the definitions in Section 2(1)(c) of the Commercial Courts Act; the specified-value requirement is addressed in Section 2(1)(i) read with Section 12. Court jurisdiction and applicable procedure must be assessed in the circumstances of the particular case.

Important distinction: Ordinary CPC Order XI also contains a Rule 7 dealing with setting aside or striking out interrogatories. The Rule 7 discussed here belongs to the substituted Order XI applicable to commercial suits. The two provisions should not be confused.
