Order XLVIII Rule 3 CPC: Use of Forms in Appendices
Order XLVIII Rule 3 of the Code of Civil Procedure, 1908 (CPC) directs the use of the prescribed forms in the appendices for their stated purposes, while permitting changes required by the circumstances of an individual case.
Statutory text: Order XLVIII Rule 3 CPC
"The Forms given in the appendices, with such variation as the circumstances or each case may require, shall be used for the purposes therein mentioned."
This rule is part of Order XLVIII (Miscellaneous) in the First Schedule to the CPC. It is also commonly referred to as Order 48 Rule 3 CPC.
Meaning and scope of Order 48 Rule 3
The rule establishes a standard approach to procedural documents used in civil proceedings. Where the CPC provides an appendix form for a particular purpose, that form is to be used for that purpose. However, the words "with such variation as the circumstances of each case may require" recognise that a standard form may need to be adapted to the facts and procedural requirements of a particular matter.
What does "forms in appendices" mean?
The appendices contain specimen formats for different stages of civil litigation, including pleadings, court process, discovery and other procedural steps. The relevant form provides a starting structure; it does not dispense with other applicable procedural requirements.
Does Rule 3 permit modifications?
Yes. The rule expressly allows variations required by the circumstances of each case. Such adaptations should remain consistent with the purpose of the form, applicable CPC provisions, court rules and directions.
Practical application in civil proceedings
When preparing a procedural document, first identify the purpose for which it is required and check whether a form is provided in the relevant CPC appendix. Use that form as the basis of the document, then supply the correct parties, court particulars, dates, relief or other case-specific details as appropriate.
For example, the appendices include specimen pleadings and forms of court process. A summons or pleading may require particulars specific to the dispute, but any changes must also comply with the rules governing that document. Order XLVIII Rule 3 does not independently determine the validity of a filing or excuse non-compliance with mandatory procedural requirements.
Related CPC provisions and official legal source
Order XLVIII contains three rules. Rule 1 concerns the expense of serving process, unless the court directs otherwise. Rule 2 concerns service of orders, notices and other documents in the manner prescribed for service of summons. Rule 3 concerns the use of appendix forms.
