Order XXI Rule 48 CPC - Attachment of Salary and Allowances

Order XXI Rule 48 of the Code of Civil Procedure, 1908 (CPC) provides a mechanism for attaching the salary or allowances of specified public-sector employees and other covered personnel to enforce a civil court decree. The court directs deductions from the attachable portion of pay, subject to the exemptions and limits in Section 60 CPC.

Meaning and scope of Order 21 Rule 48 CPC

Attachment of salary means a court-ordered withholding of a legally attachable portion of the judgment-debtor's salary or allowances for payment towards an enforceable decree. A judgment-debtor is the person against whom a decree or executable order has been made; a decree-holder is the person in whose favour it has been made.

Rule 48 covers servants of the Government, railway companies and local authorities, employees of corporations established by legislation and engaged in trade or industry, and employees of Government companies. The reference to a Government company in the older statutory text is to Section 617 of the Companies Act, 1956; the corresponding current definition appears in Section 2(45) of the Companies Act, 2013.

Rule 48(1): Court order and deductions

Where the property sought to be attached is the salary or allowances of a covered employee, the executing court may order the attachable amount to be withheld in one payment or monthly instalments. This power is expressly subject to Section 60 CPC. The rule operates even if the judgment-debtor or the salary-disbursing officer is outside the local territorial jurisdiction of the issuing court.

Following notice of the order to the officer appointed by the appropriate Government through notification in the Official Gazette:

  1. Payment within the territorial limits: the disbursing officer or other responsible person must withhold and remit the ordered amount or instalments to the court.
  2. Payment beyond those limits: the officer responsible for instructing the disbursing authority must remit the ordered amount to the court and direct corresponding reductions in the amounts disbursed.

Rule 48(2): Existing attachment

If the attachable portion of salary is already being withheld under an earlier, unsatisfied attachment order, the designated officer must promptly return the subsequent order to the issuing court with full particulars of the existing attachment. This avoids conflicting deductions from the same attachable portion.

Rule 48(3): Binding effect and liability

Unless returned under sub-rule (2), an order under Rule 48 binds the relevant Government, railway company, local authority, statutory corporation or Government company without further process in the circumstances specified in the rule. The concerned body may be liable for sums paid in contravention of the attachment order. The rule also addresses salary payable from specified Indian public funds while the employee is beyond the territorial limits to which the CPC extends.

Explanation: Appropriate Government

The Explanation identifies the Government responsible for appointing the notified officer. Broadly, the Central Government is appropriate for Central Government personnel, railway administration, cantonment and major-port authority personnel, employees of corporations established by Central Acts and specified Government companies with Central or multi-State shareholding. The State Government is appropriate for the other categories of Government, local authority, statutory corporation and Government company personnel described in the Explanation.

Section 60 CPC: How much salary can be attached?

Section 60(1) CPC defines property liable to attachment and provides exemptions. Under its salary-related provisos, the exempt amount depends on the type of decree:

For these purposes, the Explanation to Section 60 defines salary with reference to total monthly emoluments, excluding allowances declared exempt under the relevant provision. Exempt allowances and any applicable State amendments must be checked before calculating deductions.

Practical procedure for a decree-holder

  1. Apply to the competent executing court, identifying the decree, outstanding amount, employer and available pay particulars.
  2. Request attachment under Order XXI Rule 48 and disclose information relevant to Section 60 exemptions.
  3. The court considers the application and may issue an attachment order for the attachable salary.
  4. The notified officer and salary-disbursing authority implement the order in accordance with Rule 48, unless an existing attachment requires return of the subsequent order.
  5. Payments remitted to the court are applied towards satisfaction of the decree in accordance with the execution proceedings.

For private-sector employees, see Order XXI Rule 48A CPC. Other forms of movable-property attachment are governed by separate rules, including Rule 47.
