Order XXI Rule 8 CPC: Execution of Decree or Order by the Court to Which It Is Sent

Order 21 Rule 8 of the Code of Civil Procedure, 1908 explains what a District Court may do when a decree or order is transferred to it for execution: execute it itself or send it to a subordinate court with competent jurisdiction.

Text of Order XXI Rule 8 CPC

Where such copies are so filed, the decree or order may, if the Court to which it is sent is the District Court, be executed by such Court or be transferred for execution to any subordinate Court of competent jurisdiction.

Meaning and scope of Rule 8

The rule applies after the receiving court has filed the copies and certificates accompanying a transferred decree under Order XXI Rule 7. If the receiving court is a District Court, Rule 8 provides two procedural choices:

  • Execution by the District Court: the District Court may itself conduct execution proceedings.
  • Execution by a subordinate court: the District Court may transfer execution to a subordinate court that has jurisdiction to execute the decree.

Rule 8 does not confer jurisdiction on a court that otherwise lacks it. The receiving court must consider the applicable territorial, pecuniary and subject-matter jurisdiction requirements, including relevant local rules.

How transfer and execution work

1. Transfer of decree

Under Section 39 CPC, the court which passed a decree may send it for execution to another court of competent jurisdiction in the circumstances provided by that section. Order XXI Rule 5 governs the mode of transmission.

2. Transmission of documents

Order XXI Rule 6 requires the sending court to forward a copy of the decree, a certificate stating the extent of satisfaction or non-satisfaction, and a copy of any execution order or a certificate that no such order was made.

3. Filing by the receiving court

Under Order XXI Rule 7, the receiving court files these documents without further proof unless the judge records special reasons for requiring proof.

4. Execution or onward transfer

Once the documents have been filed, Rule 8 permits the receiving District Court to execute the decree itself or transfer it to a competent subordinate court. An execution application and subsequent steps are governed by the applicable provisions of Order XXI.

Illustrative example

Suppose a civil court sends a money decree for execution to a District Court in another district because the judgment-debtor has attachable property there. After the required decree documents are filed, the receiving District Court may undertake execution or transfer the matter to a subordinate court that has jurisdiction over the execution proceedings.

Frequently asked questions

Can a District Court execute a decree transferred from another court?

Yes. Order XXI Rule 8 expressly allows the receiving District Court to execute the decree after the relevant copies have been filed.

Can it send the decree to a subordinate court?

Yes, provided the subordinate court is competent to execute the decree.

Does Rule 8 itself determine whether the decree may be transferred?

No. The legal basis for transfer is principally governed by Section 39 CPC and related provisions; Rule 8 addresses execution after receipt and filing.
