Order XXX Rule 6 CPC - Appearance of Partners

Order 30 Rule 6 of the Code of Civil Procedure, 1908 governs how partners must appear when a civil suit is brought against them in the name of their partnership firm. The partners appear in their individual names, but the case continues in the firm's name.

Meaning and legal effect

Order XXX permits certain partnership litigation to proceed using the firm's name as a convenient description of the partners. Rule 6 distinguishes the individual appearance of partners from the name in which the suit continues.

1. Partners appear in their own names

When the defendants are sued as partners under the firm name, the partners who appear do so individually in their own names. This identifies the persons appearing in response to the proceedings rather than treating the firm name itself as a natural person.

2. Subsequent proceedings retain the firm name

After appearance, the suit continues in the firm's name. The pleadings, procedural steps and case caption need not automatically be converted into a suit naming every partner merely because partners have appeared.

3. Appearance does not itself decide partnership status

The rule is procedural. Whether a particular person was a partner, or is liable for the claim, may still require examination of the pleadings, evidence and applicable partnership law. Order XXX Rule 8 separately addresses appearance under protest by a person disputing that they were a partner.

Practical example

Suppose a supplier sues a partnership business under the name "ABC Traders" for unpaid invoices. The partners responding to the suit appear in their respective personal names. Nevertheless, the suit may continue in the cause title against "ABC Traders" under Order XXX, subject to the other applicable rules and any orders of the court.
