Order XXXIII Rule 12 CPC - State Government May Apply for Payment of Court Fees

Order 33 Rule 12 of the Code of Civil Procedure, 1908 (CPC) empowers the State Government to approach the court for an order directing payment of court fees in specified cases involving suits by indigent persons.

Text of Order XXXIII Rule 12 CPC

12. State Government may apply for payment of court-fees.

The State Government shall have the right at any time to apply to the Court to make an order for the payment of court-fees under rule 10, rule 11 or rule 11A.

The provision forms part of Order XXXIII - Suits by Indigent Persons, which allows qualifying litigants to institute civil suits without paying the usual court fee at the outset, subject to the conditions of the CPC.

Meaning and scope of Rule 12

Rule 12 gives the State Government an express procedural right to request a court-fee payment order. It operates with Rules 10, 11 and 11A and does not, by itself, impose an automatic fee liability in every indigent-person suit. The applicable rule and the circumstances of the case determine who is liable.

When may the State Government apply?

Rule 10 - Where the indigent plaintiff succeeds

When the plaintiff succeeds, the court calculates the court fee that would have been payable without permission to sue as an indigent person. The amount is recoverable by the State Government from the party directed by the decree to pay it, and is a first charge on the subject matter of the suit.

Rule 11 - Where the indigent plaintiff fails or the suit is withdrawn or dismissed

Rule 11 provides for an order requiring the plaintiff or a person added as co-plaintiff to pay the otherwise payable court fees when the plaintiff fails, permission to sue as an indigent person is withdrawn, the suit is withdrawn, or the suit is dismissed on the procedural grounds specified in that rule, including relevant failures relating to service of summons or non-appearance.

Rule 11A - Where the suit abates following death

Where the suit abates because of the death of the plaintiff or a person added as co-plaintiff, Rule 11A provides for recovery of the otherwise payable court fees by the State Government from the estate of the deceased plaintiff.

Procedure and recovery of court fees

  • Application: The State Government may apply to the court for an order under Rule 10, 11 or 11A. The words "at any time" appear in Rule 12; their application remains subject to other applicable law and procedural requirements.
  • Court's order: The court determines the amount and the person or property liable under the relevant provision.
  • Disputes: Under Order XXXIII Rule 13, matters between the State Government and parties arising under Rules 10, 11, 11A or 12 are treated as questions within the meaning of Section 47 CPC.
  • Recovery: Under Rule 14, a copy of the decree or order is sent to the Collector, who may recover the specified amount from the liable person or property as an arrear of land revenue, without prejudice to other available recovery modes.

Important legal provisions explained

Indigent person: For Order XXXIII, eligibility is principally assessed under the explanation to Rule 1, including whether the applicant possesses sufficient means to pay the prescribed fee, subject to the exclusions and alternative statutory test stated there.

Section 47 CPC: Provides for determination by the executing court of questions arising between parties to the suit, or their representatives, relating to execution, discharge or satisfaction of the decree, rather than by a separate suit. Rule 13 applies this framework to the specified court-fee disputes.

Rule 14 CPC: Provides a statutory mechanism for forwarding relevant orders to the Collector for recovery of court fees.
