Order XXXVIII Rule 8 CPC - Claims to Property Attached Before Judgment

Order XXXVIII Rule 8 of the Code of Civil Procedure, 1908 governs objections and claims concerning property attached before judgment. It directs the court to adjudicate those claims using the procedure applicable to claims over property attached in execution of a money decree.

Order XXXVIII Rule 8 CPC - Statutory text

Where any claim is preferred to property attached before judgment, such claim shall be adjudicated upon in the manner hereinbefore provided for the adjudication of claim to property attached in execution of a decree for the payment of money.

Meaning and purpose of Rule 8

Attachment before judgment is a protective measure imposed while a suit is pending, subject to the conditions in Order XXXVIII Rule 5 and Rule 6. An attachment does not, merely by being ordered, determine ownership of the attached property.

Adjudication of a claim means judicial examination of a person's asserted right, title or interest in the attached property. Rule 8 incorporates the procedure for resolving claims to property attached in execution of a decree for payment of money.

Procedure for a claim or objection

Claims and objections are ordinarily considered with reference to Order XXI Rule 58 CPC, which addresses claims to, or objections to attachment of, property on the ground that the property is not liable to attachment. The court examines relevant rights, title and interest in the property and decides whether the attachment should continue, be modified or be lifted.

  • Identify the property: The claimant should specify the property attached and the attachment order being challenged.
  • Explain the legal interest: The claimant should state the basis on which the property is said not to be liable to attachment, supported by relevant documents and evidence.
  • Judicial inquiry: The court determines the questions that properly arise between the parties to the claim proceeding under the applicable rules.
  • Appropriate order: Depending on the findings, the court may maintain, vary or release the attachment in accordance with law.

Order XXI Rule 58 contains procedural qualifications, including circumstances in which a claim may not be entertained and provisions governing the effect of an adjudication. Their application must be assessed in the context of an attachment before judgment and any applicable amendments.

Third-party rights and limits of attachment

Order XXXVIII Rule 10 CPC protects the rights of persons who are not parties to the suit and preserves specified rights of decree-holders. Therefore, a person asserting an independent interest in attached property may have grounds to object; the merits depend on the nature and timing of that interest and the evidence.

Rule 8 is not a substitute for the conditions required to obtain attachment in the first place. Nor does it mean that every assertion of third-party ownership automatically results in release of the property.

  • Order XXXVIII Rule 5: Conditions for requiring security for production of property and ordering conditional attachment.
  • Order XXXVIII Rule 6: Attachment where sufficient cause is not shown or security is not furnished.
  • Order XXXVIII Rule 7: Mode of making attachment, generally following execution-attachment procedures.
  • Order XXXVIII Rule 9: Withdrawal of attachment where security is furnished or the suit is dismissed.
  • Order XXXVIII Rule 10: Rights of strangers and decree-holders.
  • Order XXI Rule 58: Adjudication of claims and objections to attachment of property.
