Income Tax Act | Historical tax provisions

Section 33 of the Income-tax Act, 1961: Development Rebate Explained

Section 33 provided an additional tax deduction for qualifying investments in ships, machinery and plant. It is principally relevant to historical assessments and disputes, not as a general deduction for new investments in 2026.

Current-law context: The original development rebate scheme is historical. Do not use the percentage rates reproduced below to calculate a fresh deduction. For current expenditure, check the applicable provisions on depreciation and any separately available investment incentives under the law governing the relevant tax year.

What was development rebate under Section 33?

Development rebate was a deduction based on the actual cost of certain eligible capital assets, additional to the ordinary depreciation framework, provided the statutory conditions were met. Under Section 33(1), eligible assets included a new ship or qualifying new machinery or plant owned and wholly used for the taxpayer's business. Office appliances and road transport vehicles were generally excluded, subject to the precise historical provision.

The deduction could arise in the year of acquisition or installation, or the immediately following previous year if first put to use then. Eligibility was expressly subject to Section 34: conditions for depreciation allowance and development rebate.

Historical development rebate rates

The source text lists the following historic percentages. They are not current tax rates.

Asset or historical categoryRate under source text
Qualifying ship40% of actual cost
Specified Fifth Schedule industries, approved hotels and qualifying scientific research plant installed before 1 April 197035%
Those specified categories installed after 31 March 197025%
Other eligible machinery or plant installed before 1 April 197020%
Other eligible machinery or plant installed after 31 March 197015%

The applicable version of the statute, notification and eligibility date must be established before using any historical rate.

Section 33(1) and Section 33(1A): eligibility

Section 33(1) addressed new ships and new machinery or plant, generally requiring ownership and exclusive business use. Section 33(1A) also dealt with certain used ships acquired after 31 March 1964 and qualifying imported second-hand machinery previously used outside India, subject to safeguards against prior use or tax relief in India and other prescribed requirements.

Section 33(6) excluded machinery or plant installed in office premises or residential accommodation after 31 March 1965, with an exception for certain approved hotels in the historical text.

Section 33(2): carry-forward of unabsorbed rebate

If the taxpayer's income was insufficient to absorb the full development rebate, Section 33(2) allowed the balance to be carried forward, subject to a limit of eight assessment years. Earlier carried-forward amounts generally took priority over later amounts, under the ordering rules stated in the provision. This was a limited historic entitlement, not an indefinite carry-forward.

Section 34 and development rebate reserve

Section 33 operated together with Section 34. Among other matters, the historic scheme required compliance with prescribed conditions concerning a development rebate reserve, use of the asset and restrictions on disposal. Non-compliance could trigger withdrawal or recomputation of relief, including under the relevant provisions of Section 155. Always consult the statute as applicable to the original year.

Section 33(3) and 33(4): amalgamation and succession

Special continuity provisions applied where qualifying assets were transferred in a corporate amalgamation or when a firm was succeeded by a company. The successor could become responsible for reserve and retention conditions; any remaining rebate remained subject to the original eight-year outer limit and other requirements.

Illustrative historical calculation

Suppose qualifying machinery had an actual cost of Rs. 10,00,000 and the historical law applicable to its installation prescribed a 15% development rebate. The nominal rebate would be Rs. 1,50,000, before testing all statutory conditions and available taxable income. This is an illustration of the historical mechanism, not a claim available for a current purchase.

Position for current tax years

For tax years beginning from 1 April 2026, the Income-tax Act, 2025 is the primary new framework, subject to savings and transition rules for earlier periods. Historical references to Section 33 of the Income-tax Act, 1961 should not be confused with a section bearing the same number in a later statute. Taxpayers considering new capital investment should instead assess the current depreciation rules and any specifically applicable incentives.

Frequently asked questions

Can a business claim Section 33 development rebate on new machinery today?

Section 33 is a historical investment incentive. Its former rates should not be applied to current purchases without identifying an express applicable transitional provision.

How was the development rebate calculated?

Historically, prescribed percentages of actual cost applied to qualifying ships, plant and machinery. Rates depended on the asset, industry and acquisition or installation date.

How long could unused development rebate be carried forward?

Section 33(2) provided a maximum of eight succeeding assessment years, subject to the applicable historical conditions.

Was a development rebate reserve required?

Yes. Section 34 prescribed reserve and other conditions for claiming development rebate, subject to the version of the law relevant to the assessment year.
