Income Tax / Business Deductions / Section 33AB
Section 33AB of the Income-tax Act, 1961: Tea, Coffee and Rubber Development Accounts
Section 33AB provides a deduction linked to approved development deposits made by businesses growing and manufacturing tea, coffee or rubber in India. This guide explains eligibility, the 40% ceiling, deposit deadlines, audits, withdrawals, recapture and the treatment of historical claims.
What is Section 33AB and who qualifies?
The provision is intended to encourage investment in the development of plantations and associated manufacturing activities. The assessee must carry on the combined business of growing and manufacturing tea, coffee or rubber in India. Merely trading in these commodities, without satisfying the statutory business description, does not itself establish eligibility.
The eligible assessee must deposit funds in an account under an approved scheme administered through the National Bank for Agriculture and Rural Development (NABARD) or a deposit scheme framed by the relevant commodity board with the required government approval. The operative scheme, account terms and proof of deposit matter.
Definitions: The Tea Board, Coffee Board and Rubber Board are the statutory bodies established under their respective Acts. The National Bank refers to NABARD under the NABARD Act, 1981. The Deposit Account and special account are scheme-governed accounts, not ordinary unrestricted savings accounts.
Deduction limit and deposit deadline
Under section 33AB(1), the deduction is the lower of (a) qualifying deposits and (b) 40% of profits of the qualifying business, with business profits computed before the deduction under this section. The deduction is allowed before setting off brought-forward business losses under section 72, as specified by the provision.
| Condition | Section 33AB treatment |
|---|---|
| Eligible business | Growing and manufacturing tea, coffee or rubber in India |
| Deduction | Lower of eligible deposit and 40% of qualifying business profits |
| Deposit deadline | Six months from previous-year end or income-tax return due date, whichever is earlier |
| Audit | Prescribed audit report and applicable filing compliance |
| Repeat claim | The same deposit cannot generate a deduction in more than one year |
Illustrative calculation
Assume eligible business profits before section 33AB are Rs. 50 lakh and a qualifying deposit of Rs. 16 lakh is made in time. Forty percent of profits is Rs. 20 lakh, so the illustrative deduction is Rs. 16 lakh. If the deposit were Rs. 25 lakh, the ceiling would restrict the deduction to Rs. 20 lakh. This illustration assumes all other conditions are met.
Section 33AB: subsection-by-subsection explanation
| Provision | Meaning |
|---|---|
| 33AB(1) | Qualifying business, deposits, deadline, 40% profit limit and no duplicate deduction |
| 33AB(2) | Business-account audit and prescribed report requirements |
| 33AB(3) | Permitted withdrawals and specified events including closure, death, HUF partition, dissolution and liquidation |
| 33AB(4) | Tax treatment of funds used to buy prohibited categories of assets |
| 33AB(5) | Taxation of withdrawals following business closure or firm dissolution |
| 33AB(6) | No second deduction for expenditure financed by the qualifying fund |
| 33AB(7) | Taxation of released or withdrawn funds not used for the permitted purpose within the relevant year, subject to exceptions |
| 33AB(8) | Tax recapture when qualifying assets are transferred within the prescribed eight-year period, with exceptions |
| 33AB(9) | Power of the Central Government to specify a date after which the deduction is unavailable |
Withdrawal restrictions, disallowed uses and recapture
Amounts in the special account or Deposit Account may generally be withdrawn only for scheme-approved purposes or specified statutory events. The section identifies restricted acquisitions, including plant or machinery for offices or residential premises, certain office appliances, assets whose entire cost is already deducted, and machinery for specified Eleventh Schedule activities.
When a withdrawal is applied to a prohibited purpose, or an amount released for approved use remains unutilised within the relevant previous year, the statutory rules can deem the amount to be business income. Where scheme-financed expenditure is incurred, section 33AB(6) prevents claiming a second deduction for the same expenditure.
Section 33AB(8) also addresses disposal of an asset acquired under the scheme within eight years from the end of the previous year of acquisition. The cost attributable to the earlier deduction may be taxed in the year of transfer, subject to specified exceptions such as certain government transfers and qualifying firm-to-company succession.
