Income-tax Act, 1961 | Industrial incentives

Section 80-IC: Tax Deduction for Undertakings in Special Category States

Section 80-IC of the Income-tax Act, 1961 provided profit-linked deductions for qualifying industrial undertakings and enterprises in Sikkim, Himachal Pradesh, Uttarakhand (formerly Uttaranchal) and specified North-Eastern States. The relief depended on location, eligible manufacturing or operations, statutory commencement dates, and in some cases substantial expansion.

Important current-law context: Section 80-IC is a historical incentive tied to commencement and expansion windows that have closed. Its ten-assessment-year deduction ceiling must be considered before assuming any continuing entitlement. The Income-tax Act, 2025 came into force on 1 April 2026; claims and proceedings for earlier years must be considered under applicable transitional provisions. Do not treat the old section number as a current-year entitlement without checking the governing legislation.

What does Section 80-IC provide?

Under subsection (1), an assessee whose gross total income includes profits and gains derived from an eligible undertaking or enterprise may deduct the qualifying amount under subsection (3), subject to all other conditions. The deduction is computed on eligible business profits, not on turnover, sales or the amount invested in a factory.

Subsection (2) distinguishes eligible articles or things not listed in the Thirteenth Schedule, produced in specified notified industrial locations, from articles, things or operations listed in the Fourteenth Schedule, which are subject to the stated state-wide rules. Applicable Central Board of Direct Taxes notifications, industrial-location approvals and the schedules must be verified for the relevant year.

Eligible states, industrial locations and commencement windows

LocationHistorical commencement or expansion windowLocation / activity requirements
Sikkim23 December 2002 to before 1 April 2007Specified notified industrial zones for Thirteenth Schedule-excluded articles; Fourteenth Schedule goods or operations under the separate statutory route
Himachal Pradesh and Uttarakhand (Uttaranchal)7 January 2003 to before 1 April 2012Specified notified industrial zones, or the Fourteenth Schedule route as applicable
Specified North-Eastern States24 December 1997 to before 1 April 2007Specified notified industrial zones, or the Fourteenth Schedule route as applicable

For the purposes of this section, the specified North-Eastern States are Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland and Tripura. Sikkim is addressed separately in the section. The statutory definition must not be casually expanded to include every state ordinarily described as part of the North-East.

How much deduction was available under Section 80-IC?

Eligible undertakingDeduction from qualifying profitsOverall ceiling
Sikkim and specified North-Eastern States100% for ten assessment years beginning with the initial assessment yearTen assessment years
Himachal Pradesh and Uttarakhand100% for first five assessment years, then 25% for eligible non-company taxpayers or 30% for companiesTen assessment years in total, including relevant linked incentives

The 25% or 30% rate in the later years for Himachal Pradesh and Uttarakhand does not automatically restart at 100% merely because an existing undertaking subsequently expands. The Supreme Court in Principal Commissioner of Income Tax v. Aarham Softronics (2019) addressed substantial expansion and the initial assessment year; the interpretation must be read with the express ten-year cap and the facts of the claim.

Eligibility and restrictions under Section 80-IC

1. Manufacturing, production or eligible operations

The undertaking must carry on an eligible manufacturing or production activity, or a specified Fourteenth Schedule operation, within the applicable historical period. For the ordinary industrial-zone route, articles or things in the Thirteenth Schedule are excluded. Proof of notified location and relevant schedules is important.

2. New undertaking or substantial expansion

The provision covers qualifying new undertakings and qualifying substantial expansion within the prescribed window. Subsection (8)(ix) defines substantial expansion as an increase in investment in plant and machinery of at least 50% of the book value of plant and machinery (before depreciation in any year) as on the first day of the previous year of expansion. Accounting and fixed-asset records should support the computation.

3. No splitting or reconstruction of an existing business

Under subsection (4), the undertaking must not be formed by splitting up or reconstructing an existing business, subject to the statutory revival exception referring to Section 33B.

4. Previously used machinery or plant

The undertaking generally must not be formed by transferring previously used plant or machinery to a new business. The relevant explanations to Section 80-IA are incorporated for specified exceptions, including machinery used outside India and the limited tolerance for transferred used equipment.

5. No overlapping deductions

Subsection (5) bars another deduction under Chapter VI-A or Sections 10A or 10B in relation to the same undertaking's profits and gains. Subsection (6) imposes a maximum aggregate period of ten assessment years, including relevant periods under Section 80-IC, the second proviso to Section 80-IB(4) or Section 10C.

6. Computation, audit and related-party safeguards

Subsection (7) applies specified provisions of Section 80-IA, including rules governing computation of eligible profits, audit reporting, market-value adjustments for transfers between businesses, and arrangements that inflate profits through close connections. The precise filing and audit obligations depend on the assessment year and applicable rules.

Important statutory definitions

Initial assessment year: Under Section 80-IC(8)(v), the assessment year corresponding to the previous year when the undertaking begins manufacturing or production, commences the qualifying operation, or completes substantial expansion. Its interaction with the overall deduction period has been the subject of judicial interpretation.

Industrial Area, Industrial Estate, Industrial Growth Centre, Industrial Park, Integrated Infrastructure Development Centre and Theme Park: These refer to locations notified by the Board in accordance with the Central Government scheme, as described in subsection (8).

Software Technology Park: A park established under the Software Technology Park Scheme notified by the Government of India.

Thirteenth Schedule: Lists articles or things relevant to the exclusion under the specified industrial-zone manufacturing route.

Fourteenth Schedule: Lists articles, things and operations eligible under the alternative statutory route, subject to the remaining conditions.

Illustrative deduction calculation

Assume a qualifying company in Himachal Pradesh earned Rs. 20,00,000 of eligible profits in an assessment year within its first five-year deduction period. A 100% rate would give an illustrative deduction of Rs. 20,00,000, subject to the gross total income limit and other conditions. If the same company earned Rs. 20,00,000 in a qualifying later year to which the 30% rate applies, the illustrative deduction would be Rs. 6,00,000. The company cannot use substantial expansion to disregard the overall ten-year cap.

Documentation and practical compliance

Relevant records may include the original factory commencement certificate, statutory industrial-zone notification, factory licence, plant and machinery register, proof of substantial expansion, product classification under the Thirteenth and Fourteenth Schedules, separate profit computations, financial statements, audit report and supporting records of inter-unit transactions. Eligibility must be tested for each relevant assessment year.

Related provisions and transition to newer law

Section 80-IC should not be confused with Section 80-IB (other industrial undertakings), Section 80-IE (specified North-Eastern undertakings) or Section 80-IA (infrastructure undertakings). These are separate schemes with different dates and conditions. The 1961 Act's provisions remain relevant for historical assessments and proceedings as permitted by the transition to the Income-tax Act, 2025.

Frequently asked questions

Does Section 80-IC allow a 100% deduction for every eligible undertaking for ten years?

No. The historical rate was 100% for ten years for eligible Sikkim and specified North-Eastern undertakings. For Himachal Pradesh and Uttarakhand, the general pattern was 100% for five years, then 25% or 30% depending on the assessee, subject to the ten-year overall limit.

Can a new factory established in 2026 claim Section 80-IC?

The historical commencement windows have closed. A factory starting in 2026 does not qualify merely because it is in one of the listed states. Any relief must be examined under the legislation governing the relevant tax year.

What is substantial expansion?

It means at least a 50% increase in qualifying investment in plant and machinery measured against the prescribed opening book value before depreciation, as defined by subsection (8)(ix).

Can substantial expansion restart the ten-year deduction period?

No. Judicial interpretation may affect the initial assessment year and the applicable rate after expansion, but the express aggregate ten-assessment-year statutory ceiling remains important.

Which North-Eastern States are covered?

Section 80-IC expressly defines the group as Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland and Tripura. Sikkim is addressed separately.
