Income-tax Act, 1961 | Regional industrial incentives
Section 80-IE: Deduction for Eligible Undertakings in North-Eastern States
Section 80-IE of the Income-tax Act, 1961 provided a profit-linked tax deduction for specified manufacturing undertakings and businesses in eight North-Eastern States. Qualifying undertakings could deduct 100% of eligible profits for ten consecutive assessment years, subject to the statutory commencement window and restrictions.
What is Section 80-IE?
Under Section 80-IE(1), where an assessee's gross total income included profits derived from a qualifying undertaking carrying on activities described in subsection (2), a deduction equal to the entire eligible profits was allowed for ten consecutive assessment years starting with the initial assessment year. The provision was intended to encourage specified manufacturing, tourism, health, training and technology-related activities in the North-Eastern region.
Qualifying States and commencement dates
Section 80-IE(7)(ii) specifically defined the North-Eastern States as Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim and Tripura. This eight-state definition should not be confused with the different state lists or historical conditions of Section 80-IC.
The qualifying undertaking had to begin manufacturing or production, undertake qualifying substantial expansion, or commence an eligible business on or after 1 April 2007 and before 1 April 2017. Starting an otherwise similar business after the deadline did not by itself create a new entitlement under the historical Section 80-IE.
Three eligible activity routes
- New manufacturing or production: Commencing production of an eligible article or thing within the statutory window.
- Substantial expansion: An existing undertaking increasing qualifying plant and machinery investment by the statutory threshold to manufacture or produce an eligible article or thing.
- Specified eligible businesses: Beginning one of the expressly listed service, training, tourism, healthcare or technology businesses.
Deduction rate and period
| Requirement | Historical Section 80-IE position |
|---|---|
| Deduction amount | 100% of profits and gains derived from eligible business |
| Duration | Ten consecutive assessment years from the initial assessment year |
| Entry window | 1 April 2007 to 31 March 2017 |
| Combined deduction cap | Ten assessment years in total, counting specified prior relief under Sections 80-IC, 80-IB or 10C |
| Overlapping claims | No double deduction of the same undertaking profits under the listed Chapter VI-A or Section 10 provisions |
The deduction is computed on eligible profits, not sales, capital expenditure or total project cost. Losses, eligible business profit computations and audit requirements may affect the amount allowed.
Formation, machinery and compliance conditions
Subsection (3) excluded undertakings formed by splitting up or reconstruction of an existing business, subject to the statutory exception for qualifying revival under Section 33B. It also restricted transfer of previously used plant and machinery to a new business, subject to the explanations imported from Section 80-IA(3).
Subsection (4) prohibited duplicate deductions for the same undertaking's profits under other Chapter VI-A sections and Sections 10A, 10AA, 10B or 10BA. Subsection (5) imposed a cumulative ten-year limit across the specified incentives, including Section 80-IC, the relevant Section 80-IB proviso and Section 10C. Subsection (6) applied specified provisions of Section 80-IA, including eligible-business computation, audit, market-value transfers and anti-avoidance safeguards, as applicable.
Important statutory definitions
Substantial expansion - Section 80-IE(7)(iii)
Substantial expansion means an increase in investment in plant and machinery by at least 25% of the book value of plant and machinery, before depreciation in any year, measured as at the first day of the previous year in which expansion is undertaken. The percentage is different from the 50% threshold under Section 80-IC.
Initial assessment year - Section 80-IE(7)(i)
For manufacturing or production, it means the assessment year corresponding to the previous year in which the undertaking starts manufacturing or producing articles or things or completes substantial expansion. For undertakings pursuing specified service activities, the statutory text and applicable interpretation should be checked carefully when identifying the first year of entitlement.
Eligible articles and excluded goods - Section 80-IE(7)(iv)
The provision excluded tobacco and manufactured tobacco substitutes under Chapter 24 of the Central Excise Tariff, pan masala covered by Chapter 21, certain plastic carry bags of less than 20 microns under the cited environmental notifications, and Chapter 27 goods produced by petroleum oil or gas refineries. Classification and the law applicable to the relevant period matter.
Eligible businesses - Section 80-IE(7)(v)
- Hotels of at least two-star category.
- Adventure and leisure sports, including ropeways.
- Nursing homes with a minimum capacity of 25 beds.
- Old-age homes.
- Vocational training institutes for hotel management, catering, food craft, entrepreneurship, nursing and paramedical subjects, civil aviation, fashion design and industrial training.
- Information technology-related training centres.
- Manufacture of information technology hardware.
- Biotechnology businesses.
Section 80-IE versus Section 80-IC
Although both provisions concerned regional development, Section 80-IE covered the eight defined North-Eastern States with a 25% substantial-expansion threshold and a 100% ten-year deduction. Section 80-IC operated under different notified-state, commencement, activity and deduction-rate rules. Eligibility should never be transferred from one section to the other merely because an undertaking is situated in the North-East.
Illustrative deduction calculation
Suppose an undertaking that entered the scheme during the historical qualifying period has eligible profits of Rs. 75 lakh in an assessment year within its valid ten-year deduction period. Its preliminary deduction at 100% would be Rs. 75 lakh, subject to statutory eligible-profit computation, the gross-total-income limitation, audit and filing conditions, cumulative deduction limits and the law governing that year. The example does not imply a new 2026 entry is eligible.
Transition to the Income-tax Act, 2025
For tax years beginning on or after 1 April 2026, taxpayers must consult the Income-tax Act, 2025 and applicable transition rules. The 1961 provision remains important for historical assessments, pending appeals and examining qualifying undertakings that commenced before the statutory sunset. The correct treatment of any residual deduction period requires a year-specific legal analysis.
