Order XII Rule 3 CPC - Form of Notice to Admit Documents
Order XII Rule 3 of the Code of Civil Procedure, 1908 (CPC) specifies the prescribed form for a notice requiring another party to admit documents in a civil suit. It is part of Order XII, which deals with admissions.
Text of Order XII Rule 3 CPC
Rule 3 - Form of notice. A notice to admit documents shall be in Form No. 9 in Appendix C, with such variations as circumstances may require.
Meaning and scope of Rule 3
The rule establishes a standard format for a notice to admit documents. Form No. 9 in Appendix C of the First Schedule to the CPC provides the model notice. The words "with such variations as circumstances may require" allow the prescribed form to be adapted to the documents, parties and circumstances of a particular suit.
The purpose of the notice is to identify documents whose admission is sought, so that the parties can narrow disputes about documentary proof and avoid unnecessary expense. Rule 3 governs the form of the notice; the right to call for admissions and consequences of refusal are addressed in related provisions.
How a notice to admit documents works
- Identify the documents: Specify the documents for which admission is sought, sufficiently clearly for the receiving party to respond.
- Use the prescribed form: Prepare the notice substantially in accordance with Form No. 9 in Appendix C, adapting it as necessary.
- Serve the notice: Give the notice to the opposite party in accordance with applicable procedural requirements and any directions of the court.
- Consider the response: Order XII Rule 2 generally provides seven days from service for admission, subject to applicable amendments and court directions.
- Address disputed documents: The consequences of non-admission or failure to deny are governed by Rules 2 and 2A, including relevant safeguards and the court's discretion.
